Suspect who fled from deputies arraigned; another charged with harboring a fugitive.

LUDINGTON — The two suspects arrested Thursday, Nov. 7 for fleeing from police were arraigned today in Mason County’s 79th District Court. Donnie Ray Totten, III, 24, whose last known address was 1085 E. Hawley Road, Eden Township, was arrested by Mason County sheriff’s deputies after hiding in a crawl space at a residence in the 6500 block of East Glenn Lane in Sheridan Township  and then running from deputies for about a quarter mile, said Mason County Sheriff Kim Cole.

Christine Ann Day, 27, of Fountain, was arrested for violation of her probation and harboring a fugitive.

Shortly before 1:30 p.m., deputies — acting on information of a wanted person — responded to the home.

“As deputies approached the residence, the suspect – who is known to law enforcement – fled from under a crawl space,” Cole said. “An MCSO deputy was able to grab the suspect. However, both ended up on the ground as the suspect resisted arrest. The suspect was able to break free from the deputy and then fled on foot. He was captured following a foot chase of about a quarter mile.”

Totten has been arraigned on charges of resisting and opposing. His bond was set at $10,000 cash/surety. Day was arraigned on harboring a fugitive with a bond of $2,500/10%. Both remain lodged at the Mason County Jail.

On May 14, 2019, Day pleaded guilty May 14 to possession of a controlled substance and was sentenced to 365 days in jail with credit for 126 days served; 18 months of probation; must serve 126 days of jail time up front with the balance to be served at the court’s discretion; driver’s license suspended for 60 days and restricted for 305 days; and $658 in fines/costs. As part of a plea agreement, a charge of second offense habitual offender was dismissed.

On Sept. 16, 2014, Totten was found guilty of dangerous weapon – miscellaneous and controlled substance, use of marijuana. He was sentenced Nov. 18, 2014 to a one-year jail sentence with credit for 90 days served for each count (concurrent); serve three months up front (already served); balance to be served at the court’s discretion; two years probation; and $648 in fines and costs. One count of controlled substance, possession of marijuana was dismissed.
