LUDINGTON — The following were recently sentenced in 79th District Court:

– Christian Rodriguez, 21, 168 Deming Rd., Shelby, pleaded guilty on August 30 to receiving and concealing stolen property and was sentenced to 93 days discretionary jail for one year and must pay $543.54 in fines, costs and restitution. In exchange for the guilty plea, the prosecutor dropped two counts of third-degree retail fraud.

– Jenna Victoria Covey, 21, 115 E. Fourth St., Shelby, pleaded guilty on August 30 to third-degree retail fraud (shoplifting) and was sentenced to 93 days discretionary jail for one year and must pay $559.06 in fines, costs and restitution. In exchange for the guilty plea, the prosecutor dropped an additional count of third-degree retail fraud.

– John Joseph Stec, 52, 7032 Dowagiac Road, Free Soil Township, pleaded guilty on August 30 to second-offense operating a vehicle while intoxicated (OWI) and was sentenced to 62 days in jail with credit for two days already served, one year discretionary jail for two year, must attend impact weekend, must obtain Soberlink within six months, 20 hours of community service, must attend AA two times per week for two years, subject to random PBTs, no drugs/alcohol, vehicle used in offense must be immobilized or forfeited, must continue outpatient treatment, and pay $1,530 in fines and costs. Conviction is reportable to Secretary of State (SOS).

– David James Monroe, 53, PO Box 163, Ludington, pleaded guilty on August 30 to operating a vehicle while impaired by liquor and was sentenced to five days in jail with credit for five days already served, 93 days discretionary jail for two years, must attend victims impact panel, 107 hours of community service, no drugs/alcohol, subject to random PBTs, subject to random drug tests, must obtain substance abuse counseling, and pay $1,295 in fines and costs. Conviction is reportable to SOS.

– Jay Phillip Cutter, 36, 3085 River Rd., Manistee, pleaded guilty on August 30 to disorderly person/drunk and was sentenced to one day in jail with credit for one day already served, 90 days discretionary jail for one year, no drugs/alcohol, must obtain Soberlink within six months, subject to random PBTs, and pay $2,097.70 in fines, costs and restitution. A charge of third-degree attempted home invasion was dismissed on the motion of the prosecutor with prejudice.

– Ashley Anne Martinez, 27, 117 E. Melendy St., Ludington, pleaded guilty on August 30 to larceny less than $200 and was sentenced to 93 days discretionary jail for one year, no drugs/alcohol, must attend AA two times per week for one year, and pay $680 in fines, costs and restitution.

– Robert Joseph Golaszewski, 49, 4564 N. Morse Rd., Sheridan Township, pleaded guilty on August 30 to a general violation of wildlife conservation and was sentenced to 90 days discretionary jail for one year and must pay $1,638 in fines, costs and restitution. As part of a plea agreement, the prosecutor dropped two counts of wildlife conservation – taking deer/bear/turkeys.

– Michael Anthony Molina, 20, 408 E. Ludington Ave., Apt. B, pleaded guilty on September 1 to minor in possession of alcohol and was sentenced to one day in jail with credit for one day already served, nine months of probation, no drugs/alcohol, subject to random PBTs, must complete substance abuse counseling, and pay $265 in fines and costs. Conviction is reportable to SOS.

– Herbert Taylor Listenbee, Jr., 69, 1383 E. Kentwood St., Idlewild, pleaded guilty on September 1 to attempted snagging of fish and was sentenced to pay $275 in fines and costs.

– Cody John Janicki, 25, 520 N. Campbell, Branch Township, pleaded guilty on September 1 to transporting an open intoxicant and was sentenced to pay $265 in fines and costs. Conviction is reportable to SOS.

Dismissals

– Lisa Marie Posma, 23, 3736 W. Kistler Rd., Riverton Township, was acquitted after a trial by a judge on a charge of larceny less than $200.

– Angela Kay Parker, 34, 202 S. Rowe St., Apt. 2, Ludington, had a charge of operating without security (no insurance) dismissed without prejudice on September 1. According to court documents, “The Defendant pleaded guilty to a lesser charge.”

– Timothy Eric Smogoleski, 34, 1209 S. Washington Ave., Ludington, had a charge of assault and battery dismissed without prejudice on September 1. According to court documents, “The defendant pleaded guilty to a lesser charge.”
