79th District Court sentencings and dismissals, posted Sept. 27, 2019.

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Garth Allen Lemere, Jr., 20, of 112 S. Reinberg Ave., Scottville, pleaded guilty Sept. 17 to larceny between $200 to $1,000 and was sentenced to 90 days in jail; one year discretionary jail for one year; jail time shall run concurrent with time imposed in a separate criminal matter; and $895 in fines/costs. Charges of larceny in a building and breaking and entering were dismissed.

-Alfonso Gabriel-Cuitlahuac Lopez, 20, of 605 S. Washington Ave., Ludington, pleaded guilty Sept. 18 to failure to stop or identify after an accident and was sentenced to 60 days in jail. Conviction is reportable to Secretary of State (SOS). A charge of driving while license not valid was dismissed.

-Matthew Dustin Case, 34, of 229 E. Second St., Ludington, pleaded guilty Sept. 17 to assault and battery and was sentenced to 32 days in jail with credit for two days served; 93 days discretionary jail for one year; no contact with the victim; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $705 in fines/costs.

-Wynikqua Chanese Dean, 23, of 906 E. Ludington Ave., Ludington, pleaded guilty Sept. 17 to third degree retail fraud and was sentenced to 30 days in jail; 93 days discretionary jail for one year; and must seek and maintain employment. Charges of larceny in a building and receiving and concealing stolen property were dismissed.

-Jessica Lynn Baum, 32, of 2740 W. Kistler Rd., Riverton Township, pleaded guilty Sept. 18 to disorderly person jostling and was sentenced to two days in jail with credit for two days served; 90 days discretionary jail for one year; no contact with the victim; must turnover the sound bar to the prosecutor; and $285 in fines/costs. Charges of domestic violence and uttering and publishing a state warrant were dismissed.

-Paul Richard Carter, 57, of 624 S. Main St., Plainwell, pleaded guilty Sept. 17 to operating a vehicle while impaired by liquor (OUIL) and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; must complete alcohol highway safety education; and $1,195 in fines/costs. Conviction is reportable to SOS. A charge of speeding more than 15 mph over the limit was dismissed.

-Mariah Mae Brault, 26, of 926 E. Tinkham Ave., Apt. 313, pleaded guilty Sept. 17 to disorderly person jostling and was sentenced to three days in jail with credit for three days served; 90 days discretionary jail for one year; must seek and maintain employment; must have a mental health evaluation and follow the recommendations; no drugs/alcohol/marijuana; must cooperate with CPS and DHHS and follow their recommendations; subject to random PBTs and drug tests; and $285 in fines/costs. A charge of domestic violence was dismissed.

-Tony Lamontt James, Jr., 26, of 143 N. Jebavy Dr., Apt. 4, Ludington, pleaded guilty Sept. 17 to using a controlled substance and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; must seek and maintain employment; must have a substance abuse evaluation; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; driver’s license suspended for 30 days and restricted for 150 days; and $595 in fines/costs. Conviction is reportable to SOS.

-Nichole Alice Kolean, 27, of 922 E. Tinkham Ave., Apt. 114, Ludington; pleaded guilty Sept. 17 to operating a vehicle with a high blood alcohol content and was sentenced to two days in jail with credit for two days served; 180 days discretionary jail for one year; must seek and maintain employment; must attend victim’s impact panel; must attend the program recommended by Community Mental Health; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must complete alcohol highway safety education; and $1,435 in fines/costs. Conviction is reportable to SOS. Charges of operating a vehicle while intoxicated (OWI) and transporting an open intoxicant in a motor vehicle were dismissed.

-Kyle Theodore Lunde, 42, of 406 ½ Court St., Ludington, pleaded guilty Sept. 17 to failure to maintain security (no vehicle insurance) and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; and $635 in fines/costs. May complete 50 hours of community service and obtain car insurance in lieu of paying fines/costs. Conviction is reportable to SOS.

 

Dismissals

-Thomas James Robinson, Jr., 39, of 307 S. Rowe St., Apt. 4, Ludington, had charges of delivery/manufacturing a controlled substance and controlled substance double penalty dismissed without prejudice by the prosecutor on Sept. 19. According to court records, the prosecutor was unable to proceed with the preliminary exam.

-Kiel Jason Bode, 45, of 310 ½ Second St., Ludington, had a charge of malicious destruction of personal property dismissed with prejudice on Sept. 18.

-Raymond Joseph Utz-Harrington, 30, of 1559 N. Benson Rd., Branch Township, had a charge of failure to maintain security (no vehicle insurance) dismissed without prejudice on Sept. 19.

-Joy Caroline Tidwell, 57, of 100 S. Wildwood Crossing, Apt. 7, Amber Township, had a charge of failure to maintain security (no vehicle insurance) dismissed without prejudice on Sept. 20 after pleading guilty to a civil infraction.
