Home invasion tops 51st Circuit Court sentencings.

LUDINGTON — The following were sentenced recently in 51st Circuit Court:

Gardner

– Tyrone Gardner, 55, of 502 3rd St., Ludington, was found guilty Jan. 2 of first-degree home invasion, possession of burglar’s tools and fourth-offense habitual offender and was sentenced Feb. 27 to concurrent prison terms of 12 and a half to 50 years and six years and four months to 50 years in prison, with credit for 130 days served in jail; $104 in restitution; and $266 in fines and costs. Two counts of assaulting/resisting/obstructing police were dismissed. In a separate case, Gardner was found guilty Jan. 2 of delivery/manufacture of marijuana, maintaining a drug house and third-offense habitual offender and was sentenced Feb. 27 to concurrent terms of two and a half to eight years in prison and two years and one month to four years in prison, with credit for three days served in jail; and $326 in fines and costs. The two cases run concurrently.

Smogoleski

РTimothy Eric Smogoleski, Jr., 35, of 1790 W. US 10, Amber Township, was found guilty Dec. 6, 2017 of assaulting/resisting/obstructing police and was sentenced Feb. 27 to serve 60 days up front of a one-year discretionary jail term with credit for two days served; Secure Continuous Remote Alcohol Monitoring (SCRAM) for five months; two years probation; and $658 in fines and costs. Must report to jail March 16 and may serve sentence on weekends. Four counts of assaulting/resisting/obstructing police, one count of disorderly person/disturbing the peace and fourth-offense habitual offender were dismissed.

Alltop

– Roy James Alltop, 47, of 3745 S. 132nd Ave., Hesperia, was found guilty Jan. 2 of breaking and entering a building with intent and was sentenced Feb. 27 to serve nine months up front of a one-year discretionary jail term with credit for 112 days served; two years probation; and $658 in fines and costs. Sentence to be served concurrently with his Oceana County case.
