LUDINGTON– The following were recently sentenced in 79th District Court:

-Patti Sue Schwandt, 44, 8250 E. Johnson Rd., Branch Township, pleaded no contest to assault and battery on August 23 and was sentenced to 17 days in jail with credit for 17 days already served, 93 days discretionary jail for one year, must have a substance abuse evaluation, subject to random PBTs, subject to random drug tests and must pay $665 in fines and costs. She also pleaded no contest to operating while impaired by liquor and was sentenced to 47 days in jail with credit for 17 days already served, 93 days discretionary jail for two years, no drugs/alcohol, and must pay $870 in fines and costs. Conviction is reportable to Secretary of State.

-Stephanie Michelle Moses, 20, 411 E. Dowland St., Ludington, pleaded no contest on August 23 to operating a vehicle with a high blood alcohol content and was sentenced to three days in jail with credit for three days already served, six months discretionary jail for one year, must attend AA two times per week for one year, must attend victim’s impact panel, no drugs/alcohol, subject to random PBTs, subject to random drug tests, must continue outpatient treatment, $1,200 in fines and costs, may perform 61 hours of community service as a credit towards half of fines and costs. Conviction is reportable to Secretary of State. As part of a plea agreement, the prosecutor dismissed charges of possession of controlled substance analogues and operating while intoxicated or under a controlled substance.

-Shelton Spencer Young, 36, 2017 43rd St. SE, Apt. U1, Grand Rapids, was found guilty by the court on August 15 of a civil infraction of not having insurance and was sentenced to pay $130 in fines and costs. A misdemeanor charge of operating a motor vehicle without security (no insurance) was dismissed without prejudice in exchange for the defendant pleading guilty to a lesser charge.

-Kevin Leon Eickenberry, 54, 7035 Bluffridge Way, Indianapolis, Indiana, pleaded guilty on August 23 to operating a vehicle while impaired by liquor and was sentenced to one day in jail with credit for one day already served, 93 days discretionary jail for one year, must attend victim’s impact panel, no drugs/alcohol, subject to random PBTs, must complete alcohol highway safety education, and must pay $870 in fines and costs. Conviction is reportable to Secretary of State.

-Jeffrey Ruric Cobb, 53, 5762 Limouze, Pere Marquette Township, pleaded guilty on August 23 to prowling and was sentenced to two days in jail with credit for two days already served, 90 days discretionary jail for one year, no drugs/alcohol, must not enter the property of the Avenue Motel, 12 months of probation, and must pay $285 in fines and costs.

-Timothy Eric Smogoleski, 34, 1209 S. Washington Ave., Ludington, pleaded guilty on August 29 to disorderly person – jostling and was sentenced to one day in jail with credit for one day already served, 90 days discretionary jail for one year, no drugs/alcohol, 12 months of probation, and $285 in fines and costs.

-Heather Rae Hovinga, 35, 5627 Collins Rd., Manistee, pleaded guilty on August 23 to third degree retail fraud and was sentenced to 93 days discretionary jail for one year, must seek and maintain employment, must attend an economic crime program, and pay $535 in fines and costs.

Dismissals

-Jeremy Tristan Woollett, 29, 1336 N. Rath Ave., Pere Marquette Township, had a charge of possession of a controlled substance dismissed on August 25. Court records state, “Defendant produced a medical marijuana card valid for date of offense.”

-James Alan Alexander, 25, 4536 Russett Ct. NW, Walker, had a charge of operating with a suspended license dismissed on August 24. According to the court, “Defendant pleaded guilty to a lesser charge.”
