79th District Court sentencings and dismissals

LUDINGTON — The following were sentenced recently in 79th District Court:

Colin Michael Gourley, 27, of 5235 28th Place, SW, Apt. B, Naples, Fla., was found guilty Sept. 15 of assault and battery. He was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; no contact with the victim; and $535 in fines and costs.

Connie Marie Dust, 36, of 502 N. Harrison St., Ludington, was found guilty Sept. 15 of embezzlement less than $200. She was sentenced to 93 days discretionary jail for one year; must seek and maintain employment; must attend the Economic Crime Program; and $665 in fines and costs.

Jesse Allen Totten, 17, of 405 S. Madison Ave., Ludington, was found guilty Sept. 15 of third-degree retail fraud. He was sentenced to 30 days in jail with credit for 30 days served; 93 days discretionary jail for one year; perform 60 hours community service within six months or pay $600 in fines and costs; must enroll in and attend school with no unexcused absences; and must abide by a 7 p.m. curfew unless employed after 7 p.m. One count of minor in possession of alcohol (MIP) dismissed.

Kelly Kay Lawson, 49, of 9279 S. Three Lakes Lane, Baldwin, was found guilty Sept. 15 of operating while impaired. She was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; outpatient treatment; $935 in fines and costs; 50 hours community service within six months; must attend next session of the Victims’ Impact Panel (VIP); no alcohol/drugs; and subject to random drug tests. Conviction reportable to the Secretary of State (SOS).

Vincent Lee Peterson, 49, of 5414 N. Jebavy Dr., Hamlin Twp., was found guilty Sept. 14 of driving while license suspended (DWLS). He was sentenced to 90 days discretionary jail for one year and $225 in fines and costs. Restitution reserved. Conviction reportable to SOS.

Charles David Frank, 68, of 2812 S. Stiles Rd., Riverton Twp., was found guilty Sept. 17 of sting – selling tobacco to a minor and sentenced to $260 in fines and costs.

Joseph Ray Handshoe, 23, of 4160 S. Ordway Rd., Custer Twp., was found guilty Sept. 17 of possessing a fish without a license and sentenced to $250 in fines and costs.

Erica Desha Hinds, 25, of 1391 N. Race., Apt. 4D, Stephenville, Texas, was found guilty Sept. 17 of DWLS and sentenced to $285 in fines and costs. Conviction reportable to SOS.

Matthew William Sayger, 25, of 203 N. Rath Ave., Apt. 1, Ludington, was found guilty Sept. 17 of improper plates/failure to transfer and sentenced to $175 in fines and costs.

Edward Delbert Morley, 39, of 3883 E. Main St., Fountain, was found guilty Aug. 24 of allowing a person to drive in violation and sentenced to 90 days discretionary jail for one year and $335 in fines and costs. One count of DWLS and one count of operating without insurance were dismissed.

Gary Lee Dean, 64, of 1953 W. Tyler Rd., Hart, was found guilty Aug. 24 of allowing a person to drive in violation and sentenced to 90 days discretionary jail for one year and $335 in fines and costs. One count of DWLS was dismissed.

Carlton Kurt Brower, 53, of 2131 W. US-10/31, Amber Twp., was found guilty Aug. 24 of allowing a person to drive in violation and sentenced to two days in jail with credit for two days served; 90 days discretionary jail for one year; and $335 in fines and costs. One count of DWLS was dismissed.

Richard Paul Mauer, 21, of 880 S. Meyers Rd., Pere Marquette Twp., pleaded no contest Sept. 15 to disorderly person – public intoxication and sentenced to $285 in fines and costs.

Dismissals

Helen Bernice Snyder, 48, of 1104 Orchard St., Benzonia, one count of third-degree retail fraud was dismissed Sept. 14. “The ends of justice do not require further prosecution at this time,” court records state.

Lorenzo Cruz Hernandez, 29, of 5159 120th Ave., Hart, one count of operating a motor vehicle without security was dismissed Sept. 14. “Defendant pleaded to a lesser charge,” court records state.

Raymond Harold Snay, Jr., 49, of 881 E. Townline Rd., Free Soil Twp., one count of operating a motor vehicle without security (no vehicle insurance) was dismissed Sept. 14. “Defendant pleaded to a lesser charge,” court records state. One count of failure to register as a sex offender was dismissed Sept. 16 “without prejudice,” court records state.

Megan Elise Agustin, 27, of 219 E. Main St., Hart, one count of operating a motor vehicle without security was dismissed Sept. 15. “Defendant provided proof of insurance. “The ends of justice do not require further prosecution,” court records state.

Roger Allen Hernandez, 40, of 191 N. Bonnie St., Ludington, one count of reckless driving was dismissed Sept. 15 “per plea agreement,” according to court records.

Melissa Marie Smith, 27, of 413 ½ N. Robert St., Ludington, one count of operating a motor vehicle without security was dismissed Sept. 15. “Defendant pleaded guilty to a lesser charge,” court records state.

Amber Marie McKinley, 23, of 1164 Pineway St., Ludington, one count of operating a motor vehicle without security was dismissed Sept. 15. “Defendant pleaded guilty to a lesser charge,” court records state.
