79th District Court sentencings, posted Aug. 7, 2020

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Sean Russell Daugherty, 36, of 210 E. Filer St., Apt. 3, Ludington, pleaded guilty Aug. 5 to third degree retail fraud, malicious destruction of property and operating without a license and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; may not enter any Ludington Wesco location; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; $250 in fines/costs; and $356.85 in restitution. Conviction is reportable to Secretary of State (SOS). Charges of trespassing and illegal entry were dismissed.

-Phillip Lorenzo Formicola, 22, of 27 S. Monroe St., Custer, pleaded guilty Aug. 4 to operating a vehicle while impaired by liquor (OWIL) and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; must complete alcohol highway safety education; subject tor random PBTs; and $895 in fines/costs. Conviction is reportable to SOS.

-Eric Earl Christmann, 33, of 5984 E. Fountain Rd., Sheridan Township; pleaded guilty August 4 to OWIL and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must attend substance use disorder program; And $895 in fines/costs. Conviction is reportable to SOS.

-Tyler Jacob Young, 25, of 403 E. Third St., Ludington, pleaded no contest Aug. 4 to breaking and entering and attempted assault/resisting/obstructing police and was sentenced to one day in jail with credit for one day served; one year discretionary jail for one year; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $916 in fines/costs.

-Ronnie Cuellar Zuniga, 53, of 708 St. Catherine St., Ludington, pleaded guilty Aug. 4 to disorderly drunk person and was sentenced to one day in jail with credit for one day served; 90 days discretionary jail for one year; no drugs/alcohol; subject to random PBTs; and $285 in fines/costs. 

-Patrick Joseph Wilson, 44, of 1465 Woodlawn Dr., Clare, pleaded guilty July 28 to two counts of disturbing the peace and was sentenced to pay $335 in fines/costs.

-James Richard Boles, 60, of 2240 N. 34th St., Sheridan Township, pleaded guilty July 28 to allowing a person to drive in violation of the motor vehicle code and was sentenced to pay $125 in fines/costs.

-Michael Munoz Ratliff, 30, of 6280 Bryant Rd., Pere Marquette Township, pleaded guilty July 28 to disorderly person jostling and was sentenced to pay $285 in fines/costs.

-Brandon James Mitchell, 29, of 406 E. Ludington Ave., Apt. B, Ludington, pleaded guilty July 8 to third degree retail fraud and was sentenced to ten days in jail with credit for ten days served; 93 days discretionary jail for one year; and $686.98 in fines/costs.

-Jeffery Clay Young, 50, no address listed, pleaded guilty July 28 to third degree retail fraud and was sentenced to 50 days in jail with credit for 50 days served; 93 days discretionary jail for one year; and $195.06 in fines/costs.

-Zachary Scott Mitchell, 37, of 5434 W. Angling Rd., Victory Township, pleaded guilty July 14 to third degree retail fraud and was sentenced to pay $29.81 in restitution. Charges of stealing vehicle fuel and driving while license suspended were dismissed.

-Cody Ethan Bayer, 23, of 444 S. Meyers Rd., Amber Township, pleaded guilty July 14 to second degree retail fraud and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must continue current counseling program; and $1,113.77 in fines/costs. A charge of third degree retail fraud was dismissed.

Dismissals

-Janafae Marilyn Tess Turner, 25, of 310 Ramsdell St., Manistee, had a charge of third degree retail fraud dismissed without prejudice on July 28.
