Recent 79th District Court proceedings, posted Dec. 6, 2019.

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Matthew Jason Case, 46, of 624 E. Dowland St., Ludington, pleaded guilty Nov. 27 to domestic violence and was sentenced to 93 days in jail with credit for 17 days served and $125 in fines/costs. A charge of assault with intent to do great bodily harm was dismissed.

-Raymond Joseph Utz-Harrington, 30, of 1559 N. Benson Rd., Branch Township, pleaded guilty Dec. 3 to operating a vehicle while intoxicated (OWI) and possession of a firearm while under the influence. The jail sentence was delayed until May 26, 2020 (not to exceed one year) to determine the defendant’s eligibility for probation or other leniency compatible with the ends of justice. He must also obtain a substance abuse and mental health evaluation; no drugs/alcohol/marijuana; and subject to random PBTs and drug tests. Charges of carrying a concealed weapon and accident to fixtures were dismissed.

-Stefanie Louise Flood, 31, of 2606 N. Lakeshore Dr., Hamlin Township, pleaded guilty Oct. 29 to operating a vehicle while impaired by a controlled substance and was sentenced to 60 days in jail with credit for 60 days served; 93 days discretionary jail for two years; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must complete substance use disorder program; and $1,300 in fines/costs. Conviction is reportable to Secretary of State (SOS). 

-Chad Alan Shine, 35, of 617 Church St., Wayland, Michigan, pleaded guilty Nov. 26 to operating a vehicle while impaired by liquor (OUIL) and was sentenced to 32 days in jail with credit for two days served; 93 days discretionary jail for two years; must attend victim’s impact panel; must attend AA two times per week for two years; no drugs/alcohol; subject tor random PBTs and drug tests; must obtain substance abuse counseling; and $1,075 in fines/costs. Conviction is reportable to SOS.

-Joseph Michael Cook, 27, of 8010 N. Custer Rd., Free Soil, pleaded guilty Dec. 3 to domestic violence and was sentenced to 55 days in jail with credit for 55 days served; 93 days discretionary jail for one year; must seek and maintain employment; no contact with the victim; must have a domestic violence evaluation; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $595 in fines/costs.

-Richard Massey Thomas, 33, of 277 Sixth St., Manistee, pleaded guilty Nov. 26 to domestic violence and was sentenced to 35 days in jail with credit for five days served; 93 days discretionary jail for two years; must seek and maintain employment; must have domestic violence evaluation; no contact with the victim; and $74 in fines/costs.

-Alicia Marie Fletcher, 33, of 23602 M 40, Apt. 6, Gobles, Michigan, pleaded guilty Nov. 26 to disturbing the peace and was sentenced to one day in jail with credit for one day served; 90 days discretionary jail for one year; must comply with CPS and DHHS; must seek and maintain employment; no contact with the victim; must have substance abuse evaluation; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $285 in fines/costs. Charges of assault and battery and breaking and entering were dismissed.

-Jaqueline Martinez, 28, of 403 S. Harrison St., Ludington, pleaded guilty Nov. 26 to domestic violence and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must seek and maintain employment; no contact with the victims; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must continue current counseling program; and $595 in fines/costs. 

-Stefanie Louise Flood, 33, of 2606 N. Lakeshore Dr., Hamlin Township, pleaded guilty Nov. 26 to domestic violence and was sentenced to 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must attend AA two times per week for two year; and $525 in fines/costs.

-Michael Allen Grant, 46, of 27 S. Monroe, Lot 36, Custer, pleaded guilty Dec. 3 to OWIL and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must attend the SBIRT program at Community Mental Health; and $970 in fines/costs. Conviction is reportable to SOS.

-William Edward Rogers, 19, of 510 N. Emily St., Apt. C, Ludington, pleaded guilty Dec. 3 to failure to maintain security (no vehicle insurance) and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year and $635 in fines/costs. Conviction is reportable to SOS.

Dismissals

-David Alexander Schultz, 25, of 713 Diana St., Ludington, had a charge of third degree retail fraud dismissed without prejudice on Dec. 2 per a prosecutor’s deferral.

-Shawn Ryan Boles, 38, of 2240 N. 34th St., Sheridan Township, had a charge of domestic violence dismissed on the motion of the court with prejudice on Nov. 26.
