79th District Court sentencings and dismissals, posted May 9, 2019.

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Michael Neal Okrzesik, 37, of 6825 Travis Rd., Hamlin Township, pleaded guilty May 7 to operating a vehicle while impaired by liquor (OWIL) and was sentenced to 34 days in jail with credit for four days served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; must remain on Soberlink for one year; subject to random PBTs; must continue current counseling program; and $895 in fines/costs. Conviction is reportable to Secretary of State (SOS). A charge of driving while license suspended was dismissed.

-Julio Rocha, 33, of 1533 N. 72nd Ave., Hart, pleaded guilty May 7 to second degree retail fraud and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; and $874.38 in fines/costs/restitution. A charge of third degree retail fraud was dismissed.

-Garth Allen Lemere, Jr., 20, no address listed, pleaded guilty Apr. 30 to larceny less than $200 and was sentenced to 93 days in jail with credit for two days served and $35.65 in restitution. A second count of larceny was dismissed.

-Sally Ann Mishler, 41, of 104 N. Gay St., Scottville, pleaded guilty Apr. 30 to trespassing and was sentenced to 30 days in jail with credit for two days served; 30 days discretionary jail for two years; no drugs/alcohol; must have substance abuse evaluation; must comply with DHS/CPS; 24 months of probation; and $325 in fines/costs.

-Kevin Scott Kerr, 26, of 1247 E. Isabella Ave., Muskegon, pleaded guilty Apr. 30 to reckless driving and was sentenced to two days in jail with credit for two days served; 90 days discretionary jail for one year; subject to random PBTs; no drugs/alcohol; 12 months of probation  and $285 in fines/costs. Conviction is reportable to SOS. A charge of OWI was dismissed.

-Jenna Diane Myers, 25, of 308 E. Court St., Apt. 1, Ludington, pleaded guilty Apr. 30 to third degree retail fraud and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; no drugs/alcohol; must continue current counseling program; 12 months of probation; and $608.79 in fines/costs/restitution.

-Ethan Thomas Beetz, 19, of 183 N. Meyers Rd., Pere Marquette Township, pleaded guilty Apr. 30 to OWIL and was sentenced to 30 days in jail with credit for 30 days served; 93 days discretionary jail for two years; no drugs/alcohol; subject to random PBTs and drug tests; must attend victim’s impact panel; must complete SUD program with CMH; must maintain employment; must forfeit all drug paraphernalia; 24 months of probation; and $1,225 in fines/costs. Conviction is reportable to SOS.

 

Dismissals

-Tammy Michelle Myers, 50, of 11864 US-10, Branch, had a charge of operating without security (no vehicle insurance) dismissed without prejudice on May 6 after she pleaded guilty to a lesser charge.

-Shayne Michael Neve, 22, of 301 Sibben St., Manistee, had a charge of assault with a dangerous weapon dismissed on May 7 by the prosecutor’s office. According to court records, “Further prosecution is no longer warranted in the interests of justice.”
