NOTICE OF MORTGAGE FORECLOSURE AND SALE

Default having been made in the terms and conditions of a certain Mortgage made the 23rd day of July, 2008, by RAYMOND F. LaFRANCE and HENRIETTA M. LaFRANCE, of 2567 E. Blaine Street, Freesoil, Michigan 49411, as Mortgagor, to LAKE-OSCEOLA MORTGAGE CORPORATION, of 790 N. Michigan Avenue, P.O. Box A, Baldwin, Michigan 49304, as Mortgagee, and recorded in the office of the Register of Deeds for the County of Mason, and State of Michigan, on the 4th day of August, 2008, at 2008R04241, and assigned by said Mortgagee to LAKE-OSCEOLA STATE BANK, pursuant to an Assignment of Mortgage dated April 22, 2013, recorded in the office of the Register of Deeds for the County of Mason at 2013R03038, on which mortgage there is claimed to be due at the date hereof, for principal and interest, the sum of FORTY THREE THOUSAND EIGHT HUNDRED NINE and 26/100 DOLLARS ($43,809.26).

No suit or proceeding at law or in equity having been instituted to recover the debt, or any part of the debt, secured by said mortgage, and the power of sale contained in said mortgage having become operative by reason of such default, Notice is hereby given that on Thursday, April 4, 2019 at 1:00 p.m. at Mason County Courthouse, 304 E. Ludington Avenue, Ludington, Michigan 49431, that being the place for holding the Circuit Court for the County of Mason, there will be offered for sale and sold to the highest bidder, at public sale, for the purpose of satisfying the amounts due and unpaid upon said mortgage, with interest thereon at 7.25% per annum and all legal costs, charges and expenses, including the attorney fees allowed by law, and also any sum or sums which may be paid by the undersigned necessary to protect its interest in the premises.

Said premises are described as follows:

Parcel #1:  Situated in the Village of Freesoil, County of Mason, State of Michigan, more particularly described as:

Commencing at the Northeast corner of Lot 1, Block “H” of the Plat of the Village of Freesoil, Mason County, Michigan by H.C. Tallman Liber 1, Page 25; thence West 132 feet to the point of beginning; thence North 99 feet; thence West 132 feet; thence South 99 feet; thence East 132 feet to the point of beginning.

The redemption period shall be six (6) months from the date of such sale, unless abandoned under MCL 600.3241, in which case the redemption period shall be one month, or under MCL 600.3241a, 30 days from the date of such sale, or 15 days from the MCL 600.3241a(b) notice, whichever is later, or extinguished pursuant to MCL 600.3238.  If the above referenced property is sold at a foreclosure sale under MCL 600.3278, the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period.
