Home invasion tops 51st Circuit Court sentencings.

LUDINGTON — The following were sentenced recently in 51st Circuit Court:

Gardner

– Tyrone Gardner, 55, of 502 3rd St., Ludington, was found guilty Jan. 2 of first-degree home invasion, possession of burglar’s tools and fourth-offense habitual offender and was sentenced Feb. 27 to concurrent prison terms of 12 and a half to 50 years and six years and four months to 50 years in prison, with credit for 130 days served in jail; $104 in restitution; and $266 in fines and costs. Two counts of assaulting/resisting/obstructing police were dismissed. In a separate case, Gardner was found guilty Jan. 2 of delivery/manufacture of marijuana, maintaining a drug house and third-offense habitual offender and was sentenced Feb. 27 to concurrent terms of two and a half to eight years in prison and two years and one month to four years in prison, with credit for three days served in jail; and $326 in fines and costs. The two cases run concurrently.

Smogoleski

– Timothy Eric Smogoleski, Jr., 35, of 1790 W. US 10, Amber Township, was found guilty Dec. 6, 2017 of assaulting/resisting/obstructing police and was sentenced Feb. 27 to serve 60 days up front of a one-year discretionary jail term with credit for two days served; Secure Continuous Remote Alcohol Monitoring (SCRAM) for five months; two years probation; and $658 in fines and costs. Must report to jail March 16 and may serve sentence on weekends. Four counts of assaulting/resisting/obstructing police, one count of disorderly person/disturbing the peace and fourth-offense habitual offender were dismissed.

Alltop

– Roy James Alltop, 47, of 3745 S. 132nd Ave., Hesperia, was found guilty Jan. 2 of breaking and entering a building with intent and was sentenced Feb. 27 to serve nine months up front of a one-year discretionary jail term with credit for 112 days served; two years probation; and $658 in fines and costs. Sentence to be served concurrently with his Oceana County case.
