79th District Court sentencings posted March 9, 2018.

LUDINGTON — The following were sentenced recently in 79th District Court:

– John Charles Papes, 60, of 259 W. Fountain Rd., Sherman Township, was found guilty March 5 of taking a deer without a license and was sentenced to 90 days discretionary jail for one year and $1,250 in fines and costs.

– Douglas MacArthur Mann, 55, of 4679 1st St., Custer Township, was found guilty Feb. 27 of false pretenses less than $200 and was sentenced to 93 days discretionary jail for one year; $525 in restitution; and $535 in fines and costs.

– Gregory Thomas Carroll, 50, of 109 E. Foster St., Ludington, was found guilty Feb. 27 of assault and battery and was sentenced to 19 days in jail with credit for 19 days served; 93 days discretionary jail for one year; must continue mental health treatment; no alcohol/drugs; subject to random preliminary breath tests (PBTs); no contact with the victim; must attend AA twice a week for one year; $665 in fines and costs or perform 67 hours of community service within six months.

– Ryan Yves Maccune, 30, of 2355 N. 28th St., Sheridan Township, was found guilty March 5 of allowing a person to drive in violation and was sentenced to 90 days discretionary jail for one year and $335 in fines and costs.

– Todd Allen Smith, 45, of 2088 Joyce St., Mears, was found guilty Feb. 27 of malicious destruction of a building and was sentenced to one day in jail with credit for one day served; one year discretionary jail for one year; and $665 in fines and costs. One count of attempted third-degree home invasion was dismissed.

– Aaron Mark Tarsa, 45, of 3031 E. Decker Rd., Custer Township, was found guilty March 1 of obtaining more private land tags for antler-less deer than allowed and was sentenced to $135 in fines and costs. He was also found guilty of selling/using/loaning a license to another and was sentenced to $250 in fines and costs.

– Guadalupe Diana-Martinez, 34, of 98 Rankin St., Shelby, was found guilty March 1 of improper plates and was sentenced to perform 29 hours of community service.

– Joel Brian Bates, 30, of 7107 W. Indiana St., Hamlin Township, was found guilty Feb. 27 of operating while impaired and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend next session of the Victims Impact Panel (VIP); and $895 in fines and costs. Conviction reportable to the Secretary of State (SOS).

– Erica Hope Carey, 37, of 3441 S. Masten Rd., Logan Township, was found guilty Feb. 27 of attempted assaulting/resisting/obstructing police and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; must have a substance abuse evaluation and follow recommendations; no alcohol/drugs; subject to random PBTs; must attend AA twice a week; $665 in fines and costs or perform community service. One count of domestic violence was dismissed.

– Nichole Deann Pettinato, 39, of 379 1/2 7th St., Manistee, was found guilty Feb. 27 of driving while license suspended and was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; and $665 in fines and costs. Conviction reportable to SOS. One count of operating with a forged license was dismissed.

Dismissal

– Will Allan Wiegand, 29, of 501 N. Washington Ave., Ludington, one count of operating while intoxicated was dismissed March 2. “Defendant’s motion for a directed verdict is granted with prejudice and the case is dismissed,” court records state.
