79th District Court sentencings, dismissals.

LUDINGTON — The following were sentenced recently in Mason County’s 79th District Court:

– Diana Marie Bennett, 59, of 505 E. Filer St., Ludington, was found guilty Feb. 9 of operating while impaired by a controlled substance and was sentenced to one day in jail with credit for one day served; one year probation; 93 days discretionary jail for two years; must attend the next session of the Victims’ Impact Panel (VIP); no alcohol/drugs; must attend current counseling program; subject to random drug tests; and and $1,205 in fines and costs. Conviction reportable to the Secretary of State (SOS).

– Jerri Lynn Bertoia, 54, of 2619 N. Benson Rd., Sheridan Township, was found guilty Feb. 6 of operating while intoxicated. (OWI) and was sentenced to one day in jail with credit for one day served; Alcohol Highway Safety Education (AHSE); 93 days discretionary jail for one year; must attend next VIP session; no alcohol/drugs; subject to random preliminary breath tests (PBTs); and $1,225 in fines and costs. Conviction reportable to SOS.

– Krystal Nicole Rogers, 29, of 2239 E. Marrison Rd., Eden Township, was found guilty Feb. 6 of operating while impaired and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend next VIP session; must follow substance abuse evaluation recommendations; no alcohol/drugs; subject to random PBTs; must continue and complete Community Mental Health (CMH) counseling; and $1,000 in fines and costs. Conviction reportable to SOS. One count of marijuana possession was dismissed.

– Michelle Renee Patrick, 46, of 720 E. Ludington Ave., Ludington,was found guilty Feb. 6 of narcotic use and was sentenced to one year discretionary jail for one year; driver’s license suspended one year/restricted after 30 days; one year discretionary jail for one year; no alcohol/drugs; subject to random PBTs and drugs tests; must provide truthful testimony when called; outpatient counseling; and $535 in fines and costs. One count of narcotic/cocaine possession less than 25 grams was dismissed.

– Adam Lee Passarelli, 29, of 5643 W. Johnson Rd., Pere Marquette Township, was found guilty Feb. 6 of breaking and entering without owner’s permission and was sentenced to 27 days in jail with credit for 27 days served; outpatient treatment; 90 days discretionary jail for one year; no alcohol/drugs; subject to random PBTs and drug tests; no contact with the victim; and $415 in fines and costs. One count of disorderly person – drunk was dismissed.

– Brian Keith Kramer, 27, of 724 E. Filer St., Ludington, was found guilty Feb. of malicious destruction to of property and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; outpatient treatment; no alcohol/drugs; subject to random PBTs; and $535 in fines and costs. One count of domestic violence was dismissed.

– Seabequa Govea, 35, of 407 Lansing St., Manistee, was found guilty Feb. 12 of allowing a person to drive in violation and was sentenced to 90 days discretionary jail for one year and $335 in fines and costs.

– Kameron Douglas Kott, 23, of 599 Merky Rd., Manistee, was found guilty Feb. 8 of fishing without a license and was sentenced to $250 in fines and costs.

– Hannah Jane Smolinski, 17, of 6583 W. Maple Rd., Hamlin Township, was found guilty Feb. 8 of driving while unlicensed/never applied and was sentenced to $275 in fines and costs or 28 hours of community service. Conviction reportable to SOS.

– Cody Scott Yoder, 24, of 734 Hilty St., Filer City, was found guilty Feb. 8 of fishing without a license and was sentenced to $250 in fines and costs.

Dismissals

– Anthony Cortez Jones, 38, of 8012 Washburn Rd., Goodrich, Michigan, felony counts of assault with a dangerous weapon and assaulting/resisting/obstructing police and a second-offense habitual offender designation were dismissed Feb. 6. “Defendant has been placed into an adult foster care home which can manage his issues in conjunction with his treatment plan,” his court file states. “The ends of justice do not require further prosecution.”

– Tristin Roger Levine, 19, of 6259 N. Custer Rd., Sherman Township, one count of larceny $200-$1,000 was dismissed Feb. 7. “Per plea agreement, defendant pleaded to using artificial light to take deer,” his court file states.

– Christian Lee Mitchell, 27, of 606 E. Danaher Sr., Ludington, one count of operating without insurance was dismissed Jan. 30. “Defendant pleaded guilty to DWLS charge,” his court file states.

– Zachary John VanDusen, 19, of 1031 W. 1st St., Amber Township, one count of malicious destruction of property less than $200 and one count of failure to report accident to fixtures were dismissed Feb. 5 “per prosecutor’s deferral agreement.”
