79th District Court sentencings and dismissals

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Bryan Patrick Murphy, 41, of 511 N. Rath Ave., Ludington, pleaded guilty July 12 to assault and battery, malicious destruction of personal property and breaking and entering. He was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; $190 in restitution; and $1,080 in fines/costs. Charges of first-degree home invasion, blackmail, domestic violence and assault and battery were dismissed.

-Shawn William Paul, 48, of 109 E. Foster St., Ludington, pleaded guilty July 11 to assault and battery. He was sentenced to 25 days in jail with credit for 25 days served; 93 days discretionary jail for one year; must continue current counseling program; and $545 in fines/costs.

-Joseph Ray Flores, 30, of 8 N. Folger St., Apt. 2, Carrollton, MO, pleaded guilty July 13 to driving while license suspended (DWLS) and operating with a forged/altered license. He was sentenced to 93 days in jail. Conviction is reportable to Secretary of State (SOS). A charge of failure to maintain security (no vehicle insurance) was dismissed.

-Carl Alan Young, 50, of 4115 Jones Rd., Lapeer, Michigan, pleaded guilty July 11 to third-degree retail fraud and was sentenced to 25 days in jail with credit for 25 days served; 93 days discretionary jail for one year; no drugs/alcohol; subject to random PBTs; must continue current counseling program; $14.69 in restitution; and $535 in fines/costs. May pay $250 within six months and perform 30 hours of community service instead of paying the balance of fines/costs.

-William Jess Stubbs, 57, of 107 Jefferson St., Ludington, pleaded guilty July 11 to operating a vehicle while impaired by liquor (OUIL) and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; must complete alcohol highway safety education; and $870 in fines/costs. Conviction is reportable to SOS.

-Allison Margaret Daugherty, 26, of 924 E. Tinkham Ave., Apt. 214, Ludington, pleaded guilty July 11 to operating a vehicle while intoxicated (OWI) and was sentenced to two days in jail with credit for two day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs and drug tests; must continue current counseling program; and $1,200 in fines/costs. Conviction is reportable to SOS.

-Timothy Virgil Amburgey, 50, of 1728 E. Hansen Rd., Custer Township, pleaded guilty July 11 to OWI and carrying a concealed weapon while under the influence. He was sentenced to three days in jail with credit for three days served; 93 days discretionary jail for one year; must obtain Soberlink for one year; must attend victim’s impact panel; subject to random PBTs; weapon involved must be forfeited; and $1,220 in fines/costs. Conviction is reportable to SOS.A charge of operating with a blood alcohol content over .17 was dismissed.

-Milio Diamond Aguilar, 24, of 611 E. Dowland St., Ludington, pleaded guilty July 11 to possession of marijuana and was sentenced to three days in jail; one year discretionary jail for one year; no drugs/alcohol; driver’s license suspended for 180 days and restricted for 150 days; and $535 in fines/costs. Conviction is reportable to SOS.

-Richard Zigmund Stepka, 28, of 2092 E. US 10, Custer, pleaded guilty July 12 to second-offense OWI and was sentenced to five days in jail with credit for two days served; one year discretionary jail for two years; must obtain Soberlink for one year; subject to random PBTs, no drugs/alcohol; must attend AA five time per week for two years; must attend victim’s impact panel; must continue current counseling program; and $1,790 in fines/costs. Conviction is reportable to SOS. A charge of driving while license suspended (DWLS) was dismissed.

-Jordan Paul Clover, 33, of 2206 Stage Rd., Ionia, pleaded guilty July 10 assault and battery and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must obtain an anger management and/or substance abuse evaluation; no drugs/alcohol; subject to random PBTs and drug tests; and $535 in fines/costs. A second count of assault and battery was dismissed.

-Kyle Robert Comstock, 30, of 610 S. Danaher St., Apt. 2, pleaded guilty July 14 to OWI and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must complete substance abuse evaluation; 12 months of probation; and $870 in fines/costs. Conviction is reportable to SOS.

Dismissals

-Charles Thomas Comstock, 21, of 637 Sixth Ave., Apt. 123, Manistee, had a charge of operating a vehicle without security (no insurance) dismissed on July 12 after pleading guilty to no proof of insurance.

-Jessica Lee Holder, 32, of 103 First St., Ludington, had a charge of possession of marijuana dismissed on July 17 after she produced a valid medical marijuana card that predated the offense.

-Crystal Anne Craft, 37, of 1868 N. Benson Rd., Branch Township, had a charge of domestic violence dismissed on July 12 per a prosecutor’s deferral agreement.
