Recent 79th District Court sentencings

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court.

-Branden Michael Alpin, 34, of 2785 N. Amber Rd., Victory Township, pleaded no contest June 6 to malicious destruction of personal property and was sentenced to eight days in jail with credit for eight days served; 93 days discretionary jail for one year; no contact with the victim; no drugs/alcohol; subject to random PBTs and drug tests; and $535 in fines/costs. Charges of second-offense domestic violence and malicious destruction of a building less than $200 were dismissed.

-Joseph Michael LeClair, 57, of 3516 W. Hansen Rd., Amber Township, pleaded guilty June 6 to possession of marijuana and was sentenced to 30 days in jail with credit for eight days served; one year discretionary jail for one year; no drugs/alcohol; subject to random PBTs and drug tests; driver’s license suspended for 365 days and restricted for 305 days; and $535 in fines/costs. May perform community service in lieu of paying fines/costs. Conviction is reportable to Secretary of State (SOS).

-David Arthur Kloss, 62, of 489 Two Mile Rd., Baldwin, pleaded guilty June 6 to second-degree retail fraud and was sentenced to one day in jail with credit for one day served; one year discretionary jail for one year; must have an evaluation by Community Mental Health and follow those recommendations; $44.73 in restitution; and $535 in fines/costs.

-Lori Benedict, 56, of 510 N. Emily St., Apt. G, Ludington, pleaded no contest June 6 to third-degree retail fraud (shoplifting) and was sentenced to 93 days discretionary jail for one year; $20.72 in restitution; and $600 in fines/costs.

-Dustin Lee Lopatka, 35, of 312 N. Rath Ave., Ludington, pleaded guilty June 6 to impaired driving and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for two years; must attend victim’s impact panel after being released from an inpatient treatment program; no drugs/alcohol; subject to random PBTs and drug tests; must obtain Soberlink for one year; must enter an inpatient treatment program; and $1,115 in fines/costs. Conviction is reportable to SOS. A charge of having an open intoxicant in a motor vehicle was dismissed.

-Michael Kenneth Frey, 25, of 1039 N. William St., Ludington, pleaded guilty June 6 to driving while license suspended (DWLS) and was sentenced to three days in jail with credit for three days served; one year discretionary jail for one year; and $535 in fines/costs. Conviction is reportable to SOS. A charge of failure to maintain security (no vehicle insurance) was dismissed.

-Timothy John McDonald, 57, of 802 N. Rowe St., Apt. 4, Ludington, pleaded guilty June 6 to impaired driving and was sentenced to 30 days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; must attend AA two times per week for one year; no drugs/alcohol; subject to random PBTs; and $935 in fines/costs. Conviction is reportable to SOS.

-Robert Steven Cash, 44, of 1028 Brandy Ln., Pere Marquette Township, pleaded guilty June 6 to impaired driving and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must follow recommendations of substance abuse evaluation; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; and $870 in fines/costs. Conviction is reportable to SOS.

-Joseph Michael Haijy, 30, of 2030 Jersey Ridge Rd., Unit 10, Davenport, Iowa, pleaded guilty June 12 to trespassing with an ORV on private property and was sentenced to pay $275 in fines/costs.

-Pasha Janel Ruggles, 39, of 694 E. Thistle Rd., Hart, pleaded guilty June 8 to failure to report and accident and was sentenced to 90 days discretionary jail for one year and $325 in fines/costs.

-Alicia Barron, 45, of 4040 S. Pere Marqette Hwy., Summit Township, pleaded guilty June 8 to driving while license expired and was sentenced to pay $225 in fines/costs. Conviction is reportable to SOS.

-Johnnie William Perrigan, 53, of 132 N. Taylor Rd., Branch Township, pleaded guilty June 5 to illegally taking a deer and was sentenced to 90 days discretionary jail for one year; many not apply for hunting license until after 12/31/17; seven-point mounted head to be forfeited; and $2,485 in fines/costs.

Dismissals

-Magee Monroe Johnson, 39, no address listed, had a charge of operating while under the influence of drugs dismissed without prejudice on June 7. According to court records, “Defendant pleaded to other charges arising out of the facts and circumstances of this matter. Could not prove this specific charge beyond reasonable doubt.”
