Hamlin man sentenced for accosting child.

LUDINGTON — A 46-year-old Hamlin Township man convicted of accosting a child for immoral purposes was sentenced to serve nine months up front of a one-year discretionary jail term in 51st Circuit Court Tuesday, Feb. 14.

Scott Earl Odekirk, 46, of 3550 Stearns Dr., pleaded “no contest” to the charge and to second-offense habitual offender.

Odekirk made sexual advances toward a “strong-willed” 6-year-old girl, who said “no,” said Mason County Prosecutor Paul Spaniola.

Odekirk told her that he wanted to “kiss her on her pee spot” several times and whispered into her ear, ‘Can I kiss your boobies,?'” Spaniola said.

“The defendant makes the excuse he was drinking heavily,” the prosecutor said.

“How a (46-year-old) man could say that to a 6-year-old girl boggles my mind, and I have been practicing for 30 years,” Spaniola said.

“I’m not trying to minimize what he did,” said Odekirk’s attorney David Glancy, “but the prosecutor is blowing it out of proportion. He’s been practicing for 30 years and I have been doing this for 12 years, and I have seen way worse. He was highly intoxicated but it doesn’t excuse what he did.”

Odekirk, who is currently registered as a sex offender, received a jail term in this case, “because there was no actual sexual contact,” Spaniola said.

Judge Susan Sniegowski said she will allow him to participate in a substance abuse program if his probation agent allows it.

“I’m ashamed of what went on,” Odekirk told the judge. “There’s no excuse for it. I have a very serious problem, and I want to fix it so nothing like this ever happens again.”

Sniegowski said Odekirk has one prior felony conviction and three misdemeanor convictions.

“I do find that your behavior in this case is appalling,” the judge said.

Odekirk was also sentenced to five years probation and received credit for 68 days served in jail.
