79th District Court sentencings and dismissals

LUDINGTON — The following were sentenced recently in 79th District Court:

– Dustin Allen Collene, 34, of 106 E. Melendy St., Ludington, was found guilty June 9 of possession of marijuana; assault and battery; and breaking and entering/illegal entry. He was sentenced to 17 days in jail with credit for 17 days served; $1,078 in fines and costs; driver’s license suspended 180 days/restricted after 30 days; one year discretionary jail for two years for count 1; 93 days discretionary jail for two years for count 2; and 90 days discretionary jail for count 3; must have a substance abuse evaluation and follow recommendations; drug tests for two years; and no alcohol/drugs. One count of first-degree home invasion dismissed.

– Rachael Joy-Kraai VanOrder, 34, of 42 W. Dewey Rd., Apt. 3, Scottville, was found guilty June 15  driving while license suspended (DWLS) and sentenced to $330 in fines and costs. Conviction reportable to the Secretary of State (SOS).

– Donald Herbert Spinner, Sr., 52, of 4385 N. Reek Rd., Fountain, was found guilty June 15 of reckless driving. He was sentenced to $375 in fines and costs and 90 days discretionary jail for one year. Conviction reportable to SOS.

– Paulenea Tiffanie Hornacek, 23, of 139 Ford St., Manistee, was found guilty June 3 of DWLS. She was sentenced to two days in jail with credit for two days served; $285 in fines and costs; may enter an inpatient program through Community Mental Health; and 93 days discretionary jail for one year. In a separate file, she was found guilty May 26 of driving while license not valid sentenced to $225 in fines and costs. One count of DWLS was dismissed. Convictions reportable to SOS.

– Rishell Marie Mathewson-Petipren, 30, of 2963 N. Victory Corner Rd., Ludington, was found guilty June 11 of DWLS. She was sentenced to two days in jail with credit for two days served and $285 in fines and costs. Conviction reportable to SOS.

– Christopher Edward Swantek, 52, of 1631 Goff Rd., Fountain, was found guilty June 8 of allowing a person to drive in violation. He was sentenced to 90 days discretionary jail for one year and $335 in fines and costs. One count of second-offense DWLS was dismissed.

– Chelsy Leann Sherwood, 22, of 701 E. Loomis St., Ludington, was found guilty June 15 of disorderly conduct – fighting. She was sentenced to one day in jail with credit for one day served; 90 days discretionary jail for one year; and $285 in fines and costs.

– Devon Antjuan Galion, 19, of 1523 W. Norton Ave., Muskegon, was found guilty June 9 of failure to display a valid license and sentenced to $395 in fines and costs. Conviction reportable to SOS.

– Luke Thomas Murawski, 38, of 208 E. Foster St., Apt. B, Ludington, was found guilty June of driving while license not valid. He was sentenced to 90 days discretionary jail for one year and $225 in fines and costs. Conviction reportable to SOS.

– MaryJane Ruth Martin, 42, of Beaver Island, was found guilty June 9 of operating while intoxicated. She was sentenced to 32 days in jail with credit for two days served; outpatient treatment; $1,430 in fines and costs; 93 days discretionary jail for two years; upon completion of Impact Weekend within four months, jail term will be suspended; must attend AA three times per week for two years; no alcohol/drugs; and random preliminary breath tests (PBTs). Conviction reportable to SOS.

– Jesse Allen Outwater, 30, of 803 Diana St., Ludington, was found guilty June 9 of possession of marijuana. He was sentenced to four days in jail with credit for four days served; 90 days discretionary jail for one year; Soberlink for one year; must have a substance abuse evaluation and follow recommendations; no alcohol/drugs; $600 in fines and costs; and subject to drug testing. If he obtains a medical marijuana card, he must provide proof to the court. Conviction reportable to SOS.

– Cory Daniel Peterson, 45, of 513 S. Lincoln St., Bay City, was found guilty June 9 of second-degree retail fraud. He was sentenced to three days in jail with credit for three days served; $535 in fines and costs; outpatient treatment; and one year discretionary jail for one year.

– Willis Edward Orman III, 35, of 2902 10th St., Wayland, was found guilty June 10 of receiving and concealing stolen property. He was sentenced to three days in jail with credit for three days served; $1,760.75 restitution; and $803 in fines and costs. One count of larceny in a building was dismissed.

– Neal Barton Guss, 22, of 2091 Prough Rd., SW, South Boardman, was found guilty June 10 of allowing a person to drive in violation and sentenced to 90 days discretionary jail for one year and $335 in fines and costs.

– Jessie Curt Stickney, 36, of 815 E. Loomis St., Ludington, was found guilty June 15 of improper plates/failure to transfer. He was sentenced to 90 days discretionary jail for one year and $175 in fines and costs. One count of improper transport of medical marijuana was dismissed.

Dismissals

– Rebecca Anne Diem, 42, of 606 E. Ludington Ave., Ludington, one count of third-degree retail fraud dismissed June 16. “The ends of justice do not require further prosecution of this matter at this time,” court records state.

– Robert W. Terrel, 35, of 7275 White Swan Lane, Ludington, one count DWLS dismissed June 15. “The ends of justice do not require prosecution,” court records state.

– Kyle Alan Burchart, 24, of 6586 Ridge Rd., Pentwater, one count of DWLS dismissed June 15. “The ends of justice do not require prosecution,” court records state.

– Arthur Lee Jackson, 56, of 709 ½ E. Foster St., Ludington, one count of fourth-degree criminal sexual conduct (CSC) was dismissed June 10. “After further investigation has been conducted, the People can no longer prove the elements of this case,” court records state.

– Laurence Lavern Burns, 79, of 112 Thornwild, Apt. A-4, one count of assault with a dangerous weapon was dismissed June 9. “Defendant is in the hospital and guardianship proceedings have begun,” court records state.

– Melissa Anne Vaquera, 36, of 5881 W. Dewey Rd., Ludington, one count of domestic violence was dismissed June 9. “People cannot prove matter beyond a reasonable doubt,” court records state.
