51st Circuit Court sentencings: 3 receive prison terms

LUDINGTON — The following were sentenced recently in 51st Circuit Court:

Scherer

Scherer

– William Henry Scherer III, 45, of 7127 E. Martin Rd., Fountain, was found guilty Feb. 4 of third-offense operating under the influence of liquor (OUIL) and third-offense habitual offender. He was sentenced April 14 to a minimum of two years and a maximum of 10 years in a Michigan Department of Corrections (MDOC) prison and ordered to pay $348 in fines and costs. He was given credit for 85 days served in jail. One count of second-offense driving while license suspended (DWLS) was dismissed. Conviction reportable to the Secretary of State (SOS). Scherer was also found guilty of probation violation April 14 in two separate files and received two-four year prison sentences in each file, along with fines and costs of $498 and $525. He was given credit for 385 days served in each file. The probation violation sentences are concurrent and run concurrent to the term imposed for the recent third-offense OUIL conviction. His probation stems from a July 19, 2012 conviction of assault with a weapon and an Aug. 4, 2009 conviction of third-offense OUIL. His probation is revoked.

– Jason Edward Warren, 33, of 168 Burr St., Mt. Clemens, was found guilty Feb. 4 of second-offense controlled substance – delivery/manufacture of marijuana and second-offense controlled substance – possession (narcotic or cocaine) less than 25 grams. He was sentenced April 14 to two concurrent terms of a minimum of two years and six months to a maximum of eight years in an MDOC prison, with credit for 82 days served, and $266 in fines and costs. One count of second-offense controlled substance – possession (narcotic or cocaine) less than 50 grams and one count of second-offense controlled substance – possession of a non-narcotic were dismissed.

– Timothy Allen Dario Lopez, 21, of 143 N. Jebavy Dr., Ludington, was found guilty Feb. 10 of first-degree retail fraud and second-offense habitual offender. He was sentenced April 14 to a minimum of two years and four months to a maximum of seven years and six months in an MDOC prison, with credit for 124 days served in jail, and $198 in fines and costs. In another file, Lopez was found guilty Feb. 10 of tampering with an electronic monitoring device and second-offense habitual offender. He was sentenced April 14 to a minimum of one year and nine months to a maximum of seven years and six months in an MDOC prison, with credit for 124 days served, and $198 in fines and costs. In a third file, Lopez was found guilty Feb. 10 of retaining a financial transaction device without consent and second-offense habitual offender. He was sentenced April 14 to a minimum of one year and nine months to a maximum of six years in an MDOC prison, with credit for 124 days served; $4,203.54 in restitution, which is joint and several with a co-defendant; and $198 in fines and costs. One count of retaining a financial transaction device without consent was dismissed. All three terms are concurrent. Related story here

– Christopher Wayne Bailey, 41, of 308 E. Court St., Apt. 7, Ludington, was found guilty Feb. 10 of receiving and concealing guns and weapons/firearms possession. He was sentenced April 14 to concurrent terms of one year in jail with credit for 230 days served; two years probation; $350 in restitution that is joint and several with co-defendant Tina Bailey; and $766 in fines and costs. Two counts of felony firearms and one count of second-offense habitual offender were dismissed.

– Valerie Kay Larr, 56, of 3464 N. Amber Rd., Scottville, was found guilty Feb. 17 of embezzlement $20,000 or more. She was sentenced April 14 to 270 days in jail with credit for one day served; serve four months up front/balance to be served at the court’s discretion; $40,000 in restitution ($5,000 paid); $500 monthly minimum payment once released from jail; one year probation; and $498 in fines and costs. One count of embezzlement more than $50,000/less than $100,000 was dismissed. Related story here

– Tonya Marie Sheffield, 30, of 2611 W. First St., Scottville, was found guilty Feb. 4 of larceny in a building and second-offense habitual offender. She was sentenced April 14 to one year in jail with credit for eight days served; serve six months up front/balance to be served at the court’s discretion; $4,817.75 in restitution; $698 in fines and costs; and two years probation. One count of third-offense habitual offender was dismissed. Related story here

– Alan John Davison, 23, of 800 Davison Rd., Bitely, was found guilty Feb. 18 of controlled substance, delivery/manufacture of marijuana. He was sentenced April 14 to 180 days in jail with credit for 129 days served; serve four months up front/balance to be served at the court’s discretion; work release must meet guidelines; one year probation; driver’s license suspended six months/restricted after 30 days; $570 in restitution; and $498 in fines and costs. One count of controlled substance, delivery/manufacture of marijuana was dismissed.

– Daniel Leon King, 32, of 109 N. Delia St., Ludington, was found guilty Feb. 17 of controlled substance – delivery/manufacture of marijuana. He was sentenced April 14 to one year in jail with credit for 45 days served; serve four months up front/balance to be served at the court’s discretion; two years probation; driver’s license suspended 180 days/restricted after 30 days; and $698 in fines and costs. One count of second-offense habitual offender was dismissed.
