79th District Court sentencings

LUDINGTON — The following were sentenced recently in 79th District Court::

– Timothy John Horrack, 36, of 1486 N US-31, Scottville, was found guilty Oct. 14 of operating while impaired by liquor. He was sentenced to two days in jail with credit for two days served; Alcohol Highway Safety Education (AHSE); $870 in fines and costs; 90 days discretionary jail for one year; and must attend the next session of the Victims Impact Panel (VIP). Conviction reportable to the Secretary of State (SOS).

– Dean Alan Drake, 52, of 205 E. Melendy St., Ludington, pleaded no contest Oct. 15 to larceny $200 or more but less than $1,000. He was sentenced to 30 days in jail with credit for three days served; one year discretionary jail for two years; no contact with victim; may not serve as a caretaker for any individuals for two years; $1,079.44 in restitution; and $960 in fines and costs. One count of larceny in a building was dismissed.

– Stanton Lyle Haner, 59, of 922 E. Tinkham Ave., Apt. 109, Ludington, was found guilty Oct. 14 of operating while impaired by liquor. He was sentenced to three days in jail with credit for three days served; outpatient treatment; $1,230 in fines and costs; 93 days discretionary jail for two years; must attend next session of VIP; must attend AA twice a week for two years; no alcohol/drugs; and subject to random preliminary breath tests (PBTs). Conviction reportable to SOS.

– Ronald Eugene Sylvester, 50, of 495 Canterbury Tr., Roselle, Ill., was found guilty Oct. 15 of controlled substance, possession of marijuana. He was sentenced to two days in jail with credit for two days served; $580 in fines and costs; and one year discretionary jail for one year. Conviction reportable to SOS. One count of driving while license suspended (DWLS) was dismissed.

– Larry Allen Rotman, 70, of 3987 US-31, Scottville, was found guilty Oct. 13 of DWLS. He was sentenced to 93 days discretionary jail for one year and $285 in fines and costs. Conviction reportable to SOS.

– Chadwick Harold Butler, 44, of 5473 Sherwood Dr., Jackson, was found guilty Oct. 7 of operating while impaired by liquor. He was sentenced to one day in jail with credit for one day served; $870 in fines and costs; outpatient treatment; 93 days discretionary jail for one year; and must attend the next session of VIP. Conviction reportable to SOS.

– Kelly Michael Scharich, 41, of 2085 E. Townline Rd., Free Soil, pleaded no contest Oct. 7 to assault and battery. He was sentenced to 30 days in jail; work release allowed; 93 days discretionary jail for two years; $655 in fines and costs; and no contact with victim.

– Richard Zigmund Stepka, 25, of 2092 E. US-10, Custer, was found guilty Oct. 7 of second-offense impaired driving. He was sentenced to 31 days in jail with credit for one day served; must to report to jail Feb. 1; if he attends Impact Weekend before Feb. 1 and follows recommendations, his jail term will be suspended; outpatient treatment; no alcohol/drugs; subject to random PBTs; one year discretionary jail for two years; and $1,625 in fines and costs. Conviction reportable to SOS.

– Joseph Michael LeClair, 54, no address listed, was found guilty Oct. 7 of second-degree retail fraud. He was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; not allowed on Walmart’s property for one year; and $665 in fines and costs.

– Elmer Owen-Allound Harvey, 43, of 7147 E. Martin Rd., Fountain, was found guilty Oct. 7 of disorderly person/disturbing the peace. He was sentenced to 21 days in jail with credit for 21 days served; 90 days discretionary jail for one year; must attend the Hands Down program; no contact with victim; and $665 in fines and costs. One count of assault and battery was dismissed.

– Austin William Buchholz, 18, of 1817 W. Conrad Rd., Ludington, was found guilty Oct. 7 of controlled substance, possession of marijuana. He was sentenced to 60 days in jail with credit for two days served; one year discretionary jail for two years; jail term is concurrent with one imposed in circuit court; 25 hours community service; and a $125 fine. Conviction reportable to SOS. In a separate file, he was found guilty Oct. 7 of assault and battery. He was sentenced to 60 days in jail; jail term concurrent with time imposed in circuit court; 93 days discretionary jail for one year; 25 hours community service; and a $125 fine.

– Robert David Moran, 45, of 2663 Blair Ave., New Era, was found guilty Oct. 7 of operating while impaired by liquor. He was sentenced to two days in jail with credit for two days served; outpatient treatment; $870 in fines and costs; 93 days discretionary jail for one year; must attend next session of VIP; and no alcohol/drugs. Conviction reportable to SOS.

– Jeffrey Ruric Cobb, 51, of 408 N. James St., Ludington, was found guilty Oct. 8 of domestic violence. He was sentenced to 28 days in jail with credit for 13 days served; 93 days discretionary jail for two years; no alcohol/drugs; subject to random PBTs; must attend AA twice a week for two years; and $960 in fines and costs.

– Scott Douglas Koles, 44, of 6831 W. DEcker Rd., Ludington, was found guilty Oct. 7 of operating while intoxicated or under a controlled substance. He was sentenced to two days in jail with credit for two days served; outpatient treatment; $1,265 in fines and costs; 93 days discretionary jail for one year; must attend next session of VIP; no alcohol/drugs; subject to random PBTs; and must not purchase or possess a firearm for one year. If his father writes a letter to court and prosecutor asserting ownership of the firearms confiscated in this matter, the firearms may be returned to him. Conviction reportable to SOS. One count of possession of firearms under the influence was dismissed.

– Jennifer June Bowman, 31, of 502 E. Melendy St. Apt. 2, Ludington, was found guilty Oct. 7 of false report of a misdemeanor. She was sentenced to 93 days discretionary jail for one year; 20 hours of community service; sentence requirements concurrent with sentenced imposed in another matter; and $785 in fines and costs. One count of false report a felony was dismissed.

– Elrico James Brooks, 35, of 308 E. Court St., Apt. 2, Ludington, was found guilty Oct. 8 of disorderly person/drunk. He was sentenced to 64 days in jail with credit for 64 days served; 90 days discretionary jail for one year; and no alcohol/drugs. One count of domestic violence and one count of assault and battery were dismissed.

– Beatrice Vania Desandre, 35, no address listed, was found guilty Oct. 14 of defrauding an innkeeper. She was sentenced to 23 days in jail with credit for 23 days served; 90 days discretionary jail for one year; $582.92 in fines, costs and restitution; and may perform community service instead of paying some of the fines and costs. One more count of defrauding an innkeeper was dismissed.

Dismissal

– Jeffrey Ruric Cobb, 51, of 408 N. James St., Ludington, one count of assault by strangulation was dismissed Oct. 8. “Bond/bail is continued on remaining charge,” court records state.
