Parolee accused of sexually assaulting 10-year-old girl at local hotel

HART — A 40-year-old Holland man who is on parole is accused of sexually assaulting a 10-year-old girl at a local hotel.

Christopher Matthew Kubacki of 83 Burke Ave., Holland, is charged with felonies of first-degree criminal sexual conduct (CSC), second-degree CSC and gross indecency between a male and female, according to his court file.

The alleged assault occurred at the Days Inn hotel on Pere Marquette Highway in Summit Township, Mason County, on Oct. 21, 2023, said Oceana County Prosecutor Joseph Bizon. “This was believed to be Oceana County and was not discovered to be Mason County until after the matter was bound over to circuit court,” said Bizon. “There is a statute that allows jurisdiction up to 1 mile into a bordering county. At this time, all parties are agreeing to keep this matter in Oceana County court.”

Kubacki served previous prison terms for third-offense operating while intoxicated/impaired/under a controlled substance and fleeing police, according to Michigan Department of Corrections records.

Kubacki appeared in Oceana County’s 51st Circuit Court for a pretrial this week and is scheduled for another pretrial hearing March 18, according to court records. He remains lodged in the Oceana County Jail.

First-degree CSC is punishable by up to life in prison. Second-degree CSC carries a 15-year maximum, and gross indecency between a male and female is punishable by up to five years in prison.
