79th District Court sentencings and dismissals, posted Dec. 11, 2020.

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Bernard Joe Bovee, Jr., 47, of 1380 Victory Corner Rd., Amber Township, pleaded no contest Dec. 8 to fourth degree child abuse and was sentenced to 36 days in jail with credit for 36 days served; one year discretionary jail for one year; must have an anger management evaluation; no contact with the minor victim; and $595 in fines/costs. May perform 60 hours of community service within six month in lieu of fines/costs.

-David Duane Bothwell, 44, of 801 E. Loomis St., Ludington, pleaded guilty Dec. 8 to breaking and entering and was sentenced to 16 days in jail with credit for 16 days served. Charges of third degree home invasion and habitual offender were dismissed.

-Angelo Devin Mendez, 22, of 6509 W. Decker Rd., Hamlin Township, pleaded guilty Dec. 8 to operating a vehicle while impaired by liquor (OWIL) and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for o e year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject tor random PBTs and drug tests; must complete Alcohol Highway Safety Education; and $895 in fines/costs. Conviction is reportable to Secretary of State (SOS).

-Cheyenne Jade Badour, 24, of 1142 Pineway, Ludington, pleaded guilty Dec. 8 to OWIL and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must complete Alcohol Highway Safety Education; and $895 in fines/costs. Conviction is reportable to SOS.

-Joseph Paul Wildbahn, 55, of 2468 S. Peacock Trl, Baldwin, pleaded guilty Dec. 8 to charter boat – no certificate of insurance and was sentenced to one day in jail with credit for one day served; one year discretionary jail for one year; and $845 in fines/costs. A charge of using explosives/illegal nets for fishing use was dismissed.

-Andrea Mae Johnson, 43, of 823 N. Benson Rd., Branch Township, pleaded guilty Dec. 8 to second offense operating a vehicle while intoxicated (OWI) and was sentenced to 28 days in jail with credit for 28 days served; one year discretionary jail for two years; must have a substance abuse evaluation; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must complete Alcohol Highway Safety Education; and $1,500 in fines/costs. Conviction is reportable to SOS.

-Victoria Jane Williams, 27, of 2026 Cannon Dr. SW, Wyoming, pleaded guilty Dec. 8 to second offense OWI and was sentenced to one day in jail with credit for one day served; one year discretionary jail for two years; must attend AA three times per week for two years; no drugs/alcohol/marijuana/controlled substances; must attend victim’s impact panel; subject to random PBTs and drug tests; must seek outpatient treatment; and $1,250 in fines/costs. Conviction is reportable to SOS. Charges of driving while license suspended and transporting an open intoxicant in a vehicle were dismissed.

-Sidney Joshua May, 25, of 309 Fifth St., Ludington, pleaded guilty Dec. 8 to third degree retail fraud and was sentenced to 93 days discretionary jail for one year and $125 in fines/costs.

Dismissals

-Julie Ann Martin, 44, of 4068 E. Church St., Fountain, had a charge of assault and battery dismissed without prejudice on Dec. 3.

-Jason Matthew Fox, 45, of 610 N. Rowe St., Ludington, had a charge of assault and battery dismissed without prejudice on Dec. 3.

-Matthew Jason Case, 47, of 624 E. Dowland St., Ludington, had a charge of operating a vehicle without security (no insurance) dismissed without prejudice on Dec. 1 after pleading guilty in a felony case.

-Christopher William Marcott, 36, of 2693 N. Victory Corner Rd., Amber Townsihp, had a charge of breaking and entering dismissed without prejudice on Dec. 3.

-Kody Michael Shriver, 29, of 1005 N. Custer Rd, Ludington, had a charge of malicious destruction of personal property dismissed without prejudice on Dec. 7 as part of a plea agreement.

-William Lee Dustman, 77, of 506 S. George St., Ludington, had charges of operating a vehicle without security (no insurance), unlawful license plates and operating an unregistered vehicle dismissed without prejudice on Dec. 7.

-Jason Lee Carr, 36, of 504 E. Dowland St., Ludington, had two counts of possession of a controlled substance dismissed without prejudice on Dec. 9 because prosecution was prohibited under the Good Samaritan Act.
