79th District Court sentencings and dismissals, posted March 22, 2019.

LUDINGTON — The following were recently sentenced in Mason County’s 79th District Court:

-Michael Mason Durham, 28, of 110 N. Washington Ave., Ludington, pleaded guilty Mar. 12 to domestic violence and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; must have a substance abuse evaluation; no contact with the victim; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; and $795 in fines/costs.

-Rebecca Nicole Miller, 27, of 806 N. Lakeview St., Ludington, pleaded guilty Mar. 12 to operating a vehicle while impaired by liquor (OWIL) and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol; subject to random PBTs; must complete alcohol highway safety education; and $870 fines/costs. Conviction is reportable to Secretary of State (SOS).

-Joel Oliver Crookston, 34, of 8585 Newells Ln., Portage, pleaded guilty Mar. 12 to OWIL and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol or controlled substances without a prescription; subject to random PBTs and drug tests; must complete alcohol highway safety education; and $895 fines/costs. Conviction is reportable to Secretary of State (SOS).

-Jonathan Raymond Witt, 35, of 714 Dexter St., Ludington, pleaded guilty Mar. 12 to operating while intoxicated (OWI) and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must complete inpatient treatment; and $1,275 fines/costs. Conviction is reportable to Secretary of State (SOS). Charges of driving with an expired license and expired registration were dropped.

-Michael John Posma, 29, of 1388 W. Sugar Grove Rd., Victory Township, pleaded guilty Feb. 12 to OWI and was sentenced to two days in jail with credit for two days served; 93 days discretionary jail for one year; no drugs/alcohol; must attend victim’s impact panel; subject to random PBTs; and $895 in fines/costs. Conviction is reportable to SOS.

-Blake Andrew Barrette, 18, of 191 Bonnie St., Pere Marquette Township, pleaded guilty Mar. 12 to operating while intoxicated (OWI) and was sentenced to 17 days in jail with credit for 17 days served; 93 days discretionary jail for two years; 60 hours of community service; must attend AA two times per week for two years; must attend victim’s impact panel; must have a substance abuse evaluation; no drugs/alcohol/marijuana; subject to random drug tests and PBTs; must complete alcohol highway safety education; and $1,275 in fines/costs. Conviction is reportable to SOS. A charge of violation of a restricted license was dismissed.

-April Rae Wolfe, 38, of 5689 W. Fox Rd., Mears, pleaded guilty Mar. 13 to OWI second offense and driving with a suspended license and was sentenced to 25 days in jail with credit for one day served; one year discretionary jail for two years; must attend outpatient treatment; must attend victim’s impact panel; no drugs/alcohol/marijuana or controlled substances without a prescription; subject to random PBTs and drug tests; must forfeit or immobilize vehicle; and $2,050 in fines/costs. Conviction is reportable to SOS. A felony charge of third offense OUIL was dismissed.

-Jorge Luis Garcia-Hernandez, 24, of 2272 E. Sugar Grove Rd., Sherman Township, pleaded guilty Mar. 12 to OWIL and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail for one year; must attend victim’s impact panel; no drugs/alcohol/marijuana; subject to random PBTs and drug tests; must attend substance abuse disorder program; and $895 in fines/costs. Conviction is reportable to SOS. A charge of failure to stop after an accident was dismissed.

-Carlos Masariegos, 51, of 6612 W. Linden Rd., Hamlin Township, pleaded guilty Mar. 13 to disorderly person jostling and was sentenced to 19 days in jail with credit for 19 days served; 90 days discretionary jail for two years; must not enter any establishment where alcohol is served by the glass; no drugs/alcohol/marijuana or controlled substance without a prescription; subject to random PBTs and drug tests; and $325 in fines/costs.

Dismissals

-Breanna Helen Kist, 20, of 2685 E. Hawley Rd., Eden Township, had a charge of domestic violence dismissed without prejudice on Mar. 12 per a prosecutor’s deferment agreement.

-Nadeen Ann Murphy, 59, of 1125 N. Quarterline Rd., Amber Township, had a charge of operating while intoxicated (OWI) dismissed without prejudice on Mar. 12 per a plea agreement.

-James Fred Kirschke, 56, of 2204 Berrywood Ln., Bloomington, Illinois, had a charge of operating without security (no vehicle insurance) dismissed without prejudice on Mar. 12.

-Blaine Austin Beemer, 22, of 269 E. Fountain Rd., Sherman Township, had a charge of operating without security (no vehicle insurance) dismissed without prejudice on Mar. 12 per a plea agreement.
