79th District Court sentencings and dismissals, posted Jan. 24, 2019.

LUDINGTON  — The following were recently sentenced in Mason County’s 79th District Court:

-Tony Jerome Lopez, 44, of 5190 S. Scottville Rd., Eden Township, pleaded guilty Jan. 18 to disorderly person jostling and was sentenced to 49 days in jail with credit for 49 days served, 90 days discretionary jail for one year, no drugs/alcohol, and $285 in fines/costs. A charge of aggravated domestic assault was dismissed.

-Amber Lynn Hawkins, 31, of 8007 W. Taylor Rd., Roars, Michigan, pleaded guilty Jan. 18 to disorderly person disturbing the peace and was sentenced to 90 days discretionary jail for one year and $285 in fines/costs. A charge of receiving and concealing stolen property was dismissed.

-Allen Michael Mallison, 30, of 478 ½ First St., Manistee, pleaded guilty Jan. 15 to operating while impaired by a controlled substance and was sentenced to 93 days in jail with credit for 93 days served and $125 in fines/costs. Conviction is reportable to Secretary of State (SOS).

-Tom Charles Smogoleski, Jr., 40, of 4712 W. Decker Rd., Victory Township, pleaded guilty Jan. 15 to operating while impaired by liquor (OWIL) and was sentenced to one day in jail with credit for one day served, 93 days discretionary jail for one year, must attend victim’s impact panel, no drugs/alcohol, subject to random PBTs, and $895 in fines/costs. Conviction is reportable to SOS.

-Abby Lynn Handshoe, 27, of 4160 S. Ordway Rd., Eden Township, pleaded guilty Jan. 15 to operating while intoxicated (OWI) and was sentenced to one day in jail with credit for one day served, 93 days discretionary jail for one year, must attend victim’s impact panel, no drugs/alcohol, subject to random PBTs, must continue current outpatient counseling, and $1,295 in fines/costs. Conviction is reportable to SOS. A charge of operating with a blood alcohol level greater than .17 was dismissed.

-Jeffrey Allen Grant, 54, of 111 E. Melendy St., Ludington, pleaded guilty Jan. 15 to allowing a person to drive in violation of the motor vehicle code and was sentenced to two days in jail with credit for two days served, 90 days discretionary jail for one year, must attend AA/NA twice per week, subject to random PBTs and $335 in fines/costs. A charge of second offense driving while license suspended (DWLS) was dismissed.

-Ashley Michelle Cleveland, 31, of 506 E. Danaher St., Apt. 4, Ludington, pleaded guilty Jan. 17 to driving with an expired license and was sentenced to pay $225 in fines/costs. Conviction is reportable to SOS.

Dismissals

-Layla Renee Lefevre, 19, of 802 N. Rowe St., Apt. 4, Ludington, had a charge of possession of synthetic marijuana dismissed on Jan. 15 after pleading guilty to a civil infraction.

-Michael Patrick Ellison, 49, of 5219 N. Jebavy Dr., Hamlin Township, had a charge of domestic violence dismissed on Jan. 15. According to court records, “People cannot prove that an assault occurred beyond a reasonable doubt.”

-Bob Lee Gutschke, Jr., 39, of 509 Seventh St., Ludington, had charges of possession of synthetic marijuana and operating with a suspended license dismissed on Jan. 15.  According to court records, the dismissal was “In the interest of justice.”
