51st Circuit Court sentencings include armed robbery, assault, accosting children.

LUDINGTON — The following were sentenced recently in 51st Circuit Court:

Miller

Miller

Mark Anthony Miller, 42, of St. Louis Correctional Facility, 8585 N. Croswell, St. Louis, Mich., was found guilty Oct. 30 of armed robbery (Branch Grocery) and fourth-offense habitual offender. He was sentenced Jan. 5 to 15 years to life in prison with credit for 383 days served in jail; $362 in restitution; and $258 in fines and costs. Sentence to run concurrently to Muskegon County offenses. Three counts of felony firearms and two counts of assault with a weapon were dismissed.

Tyrone Gardner, 53, of 103 Reinberg Ave., Scottville, was found guilty Nov. 4 of attempted assault with a weapon and fourth-offense habitual offender. He was sentenced Jan. 5 to one year in jail with credit for 84 days served; two years probation; and $658 in fines and costs. Restitution is reserved. One count of assault with a weapon; one count of possession of firearms/weapons; and one count of felony firearms were dismissed.

James Philbrick Gigante, 49, of 6116 N. Quarterline Rd., Victory Township, was found guilty Oct. 13 of accosting children for immoral purposes and possession of child sexually-abusive material. He was sentenced Jan. 12 to serve four months up front of two concurrent one-year discretionary jail terms with credit for two days served, followed by three months on a tether; work release must meet MCSO guidelines; five years probation; and $1,126 in fines and costs. Two counts of using a computer a commit a crime were dismissed.

Kyle David Blanchard, 41, of 7164 S. Pere Marquette Hwy., Summit Township, was found guilty by a jury Nov. 19 of second-offense delivery/manufacture of marijuana. He was sentenced Jan. 12 to serve six months up front of a one-year discretionary jail sentence; work release must meet Mason County Sheriff’s Office guidelines; 18 months probation; driver’s license suspended 60 days/restricted 305 days; and $808 in fines and costs.

Brian David Sheffield II, 27, of 502 E. Danaher St., Apt. 1, Ludington, was found guilty Nov. 24 of delivery/manufacture of marijuana. He was sentenced Jan. 12 to serve 45 days up front of a one-year discretionary jail sentence; driver’s license suspended 30 days/restricted 150 days; and $658 in fines and costs.

Tyler Adam Martinsen, 23, of 214 Thornwild Dr., Apt. 2, Scottville, was found guilty Nov. 25 of failure to register as a sex offender. He was sentenced Jan. 12 to one year in jail with credit for 16 days served; 180 days on a tether; 18 months probation; and $658 in fines and costs. Two counts of failure to register as a sex offender were dismissed.

Alyxander Carl Smith, 22, of 205 E. Melendy, Ludington, was found guilty of probation violation and sentenced Jan. 12 to serve 164 days up front of a one-year discretionary jail sentence with credit for 163 days served and $859 in fines and costs. Probation stems from a Jan. 17, 2014 conviction of  retaining a financial transaction device without consent. In a separate file, Smith was found guilty Nov. 25 of retaining a financial transaction device without consent and embezzlement of a vulnerable adult. He was sentenced Jan. 12 to serve nine months up front of two concurrent one-year jail terms with credit for 72 days served; work release must MCSO guidelines; two years probation; $4,999.62 in restitution; and $926 in fines and costs. Both files run concurrently. Two counts of retaining a financial transaction device without consent and one count of second-offense habitual offender were dismissed.

William Rhody Dwyer, Jr., 24, of 11365 Kistler Ave., Allendale, was found guilty Nov. 17 of attempted first-degree criminal sexual conduct (CSC) with a person under age 13. He was sentenced Jan. 5 to one year in jail with credit for 113 days served; 180 days on a tether following his release from jail; five years probation; and $658 in fines and costs. Two counts of first-degree CSC and one count of second-degree CSC were dismissed.

Thomas Lee Tribble, 60, of 4851 N. Cleveland St., Fountain, was found guilty Nov. 10 of attempted assault with a weapon. He was sentenced Jan. 5 to serve 90 days up front of a 270-day discretionary jail sentence with credit for 10 days served; one year probation; and $658 in fines and costs. One count of assault with a weapon; one count of felony firearms; and two counts of second-offense domestic violence were dismissed.

Lee Borema, 39, of 5372 N. Thunderbird Dr., Sheridan Township, was found guilty Nov. 10 of third-offense operating under the influence of liquor (OUIL). He was sentenced Jan. 5 to serve six-months up front of a one-year discretionary jail sentence with credit for two days served; two years probation; work release must meet MCSO guidelines; 60 days community service; vehicle immobilization; and $1,108 in fines and costs. Conviction reportable to the Secretary of State (SOS). One count of third-degree fleeing a police officer and one count of second-offense driving while license suspended (DWLS) were dismissed.

Michael Scott Bailey, 25, of 1050 Terry Ave., Mt. Morris, Mich., was found guilty Nov. 10 of second-degree home invasion. He was sentenced Jan. 5 to serve six months up front of a one-year discretionary jail sentence with credit for five days served; two years probation; and $658 in fines and costs. Three counts of felony firearms; one count of first-degree home invasion;  one count of larceny; and one count of felony firearms were dismissed.

Michael Ryan Albaugh, 26, of 6728 N. Woodbridge Rd., White Cloud, was found guilty Oct. 14 of fourth-degree CSC – victim aged 13-16 years. He was sentenced Jan. 5 to one year in jail with credit for seven days served; five years probation; and $658 in fines and costs. Sentence runs concurrently to Oceana County and Lake County cases. One count of attempted first-degree CSC – victim under 13; one count of second-degree CSC – victim under 13; selling/furnishing alcohol to a minor; and third-offense habitual offender were dismissed.

Jesse Donald Talmadge, 28, of 508 E. Danaher St., Apt 1, Ludington, was found guilty Oct. 7 of maintaining a drug house. He was sentenced Jan. 5 to serve 45 days up front of a one-year discretionary jail term with credit one day served; one year probation; driver’s license suspended 30 days/restricted 150 days; and $658 in fines and costs. One count of possession less than 25 grams and one count of possession of marijuana were dismissed.

Tina Ann Bailey, 35, of 308 E. Court St., Apt. 7, Ludington, was found guilty of probation violation and sentenced Jan. 5 to two terms of one year and nine months to five years in prison with credit for 405 days served in jail; and $1,416 in fines, costs and restitution. Her probation is revoked. Probation stems from Jan. 21, 2015 convictions of possession of firearms and larceny.
