79th District Court sentencings

LUDINGTON — The following were sentenced recently in 79th District Court:

– Samuel Davis Vanderark, 20, of 3074 4 Mile Rd., Walker, was found guilty Dec. 7 of operating while impaired by liquor. He was sentenced to one day in jail with credit for one day served; outpatient treatment; $870 in fines and costs; 93 days discretionary jail for one year; must attend AA once a week; no alcohol/drugs; must submit to random preliminary breath tests (PBTs); and must attend the next session of the Victims’ Impact Panel (VIP). Conviction reportable to the Secretary of State (SOS). One count of minor in possession (MIP) dismissed.

– Eric Zelek Hoggs, 39, of 724 E. Filer St., Ludington, was found guilty Dec. 7 of driving while license suspended (DWLS). He was sentenced to 17 days in jail with credit for 17 days served; $285 in fines and costs; and 93 days discretionary jail for one year. Conviction reportable to SOS.

– Bernard Joe Bovee, Jr., 42, of 6590 E. Beech St., Sheridan Township, was found guilty Dec. 7 of DWLS and sentenced to $275 in fines and costs and 90 days discretionary jail for one year.

– Daniel Lee McClure, 29, of 606 N. Delia St., Ludington, was found guilty Dec. 4 disorderly person – disturbing the peace. He was sentenced to six days in jail with credit for six days served; outpatient treatment; $285 in fines and costs; 90 days discretionary jail for one year; no alcohol/drugs; and subject to random PBTs and drug tests. One count of second-offense domestic violence was dismissed.

– Catarino Rocha Ramirez, 43, of 5742 N. 126th Ave., Hart, was found guilty Dec. 2 of second-degree retail fraud. He was sentenced to 31 days in jail with credit for 31 days served; $894.30 in fines, costs and restitution; and one year discretionary jail for one year.

– Lavonte TaShawn-Bruce Moses, 22, of 191 Bonnie St., Ludington, was found guilty Dec. 1 of breaking and entering without owner’s permission. He was sentenced to 28 days in jail with credit for 28 days served; 90 days discretionary jail for one year; and $600 in fines and costs.

– Rafael Garza, Jr., 42, of 2547 W. Kinney Rd., Riverton Township, was found guilty Dec. 1 of failure to maintain security (no vehicle insurance) and sentenced to one year discretionary jail for one year; $1,349.33 in restitution; and $535 in fines and costs. Conviction reportable to SOS. One count of failure to stop after a property damage accident dismissed.

– Calvin James Greiner, 30, of 3677 S. Pere Marquette Hwy., Ludington, was found guilty Dec. 1 of operating while intoxicated. He was sentenced to two days in jail with credit for two days served; Alcohol Highway Safety Education (AHSE); $1,430 in fines and costs; 93 days discretionary jail for two years; must obtain substance abuse counseling and follow recommendations; must attend Impact Weekend and follow recommendations; if Impact Weekend is not completed within four months, must report to jail for 30 days; no alcohol/drugs; and subject to random PBTs and drug tests. Conviction reportable to SOS.

– Robert Roy Lange, 29, of 162 Harrison St., Manistee, was found guilty Dec. 1 of DWLS and sentenced to two days in jail with credit for two days served; one year discretionary jail for one year;and $535 in fines and costs. Conviction reportable to SOS. One count of reckless driving dismissed.

– Eric Michael Sherman, 32, of c/o of 5502 Hazelwood Dr., Pere Marquette Township, was found guilty Dec. 1 of disorderly person – disturbing the peace. He was sentenced to two days in jail with credit for two days served; 90 days discretionary jail for one year; must attend the Hands Down program; and no contact with the victim. One count of second-offense domestic violence was dismissed.

– Nancy Ann Lefler, 60, of 770 W. Deer Run Rd., Grant Township, was found guilty Dec. 1 of operating while intoxicated. He was sentenced to two days in jail with credit for two days served; AHSE; $1,200 in fines and costs; 93 days discretionary jail for one year; must attend the next session of VIP; no alcohol/drugs; subject to random PBTs; and must complete 60 hours of community service within six months. Conviction reportable to SOS.

– Jennifer Ann Fitch, 29, of 504 5th St., Ludington, was found guilty Dec. 1 of operating while impaired. She was sentenced to one day in jail with credit for one day served; $935 in fines and costs; AHSE; 93 days discretionary jail for one year; must attend next session of VIP; no alcohol/drugs; and must submit to random PBTs. Conviction reportable to SOS. One count of failure to stop after a property damage accident was dismissed.

– Leticia Rocha Maya, 38, no address listed, was found guilty Dec. 1 of third-degree retail fraud. She was sentenced to $535 in fines and costs; 93 days discretionary jail for one year; jail credit for time already served; and may leave US and return to Mexico.

– Michael Jon Rolph, 52, of 7353 S. 44th Ave., Montague, was found guilty Dec. 3 of driver transporting open intoxicants and sentenced to $265 in fines and costs. Conviction reportable to SOS.

– Michael Mason Durham, 25, of 302 N. Robert St., Apt. 1, Ludington, was found guilty Nov. 20 of trespassing and sentenced to $265 in fines and costs; no trespassing; and 30 days discretionary jail for one year. One count of breaking and entering – illegal entry was dismissed.

– Olivia Danielle Hunter, 22, of 502 1/2 N. Rowe St., Ludington, was found guilty Dec. 4 of disorderly person – disturbing the peace. She was sentenced to nine days in jail with credit for nine days served; outpatient treatment; $285 in fines and costs; 90 days discretionary jail for one year; no alcohol/drugs; and subject to random PBTs ad drug tests. One count of second-offense domestic violence dismissed.

– Erin Nicole Granlund, 18, of 3556 Goodman Ave., Wyoming, Michigan, was found guilty Dec. 3 of driving while license expired and sentenced to $225 in fines and costs. Conviction reportable to SOS.

– John Dennis Shafer, 53, of 1482 W. Birch St., Victory Township was found guilty Dec. 3 of driver transporting open intoxicants in a vehicle and sentenced to $265 in fines and costs. Conviction reportable to SOS.

– Brian David Balder, 35 of 3930 Automobile Rd., Muskegon, was found guilty Dec. 3 of driver transporting open intoxicants in a vehicle and sentenced to $265 in fines and costs. Conviction reportable to SOS.

– Josiah Alan Holman, 33, of 889 Irwin Ave., Muskegon, was found guilty Dec. 3 of taking a deer without a license. He was sentenced to $1,250 in fines and costs and his hunting license is revoked for the balance of 2015 and the next three consecutive years.

– Jacob Anthony Lake, 20, of 7060 Ohio Rd., Hamlin Township, was found guilty Dec. 3 of second-offense minor in possession of alcohol and sentenced to $335 in fines and costs. Conviction reportable to SOS.

– Barney Elmer Kelly, Jr., 50, of 6152 E. US 10, Branch Township, was found guilty Dec. 3 of allowing a minor to hunt deer unsupervised and sentenced to $225 in fines and costs.

– Michael Dale Miston, 57, of 4896 Cleveland Ave., Stevensville, was found guilty Dec. 3 of using/loaning a kill tag to another and sentenced to $250 in fines and costs.

– Candace Jean Wittlieff, 59 of 2169 E. Hoague Rd., Free Soil Township, was found guilty Dec. 3 of using/loaning a kill tag to another and sentenced to $250 in fines and costs.

– Patrick Kendall Rogers, 45, of 207 Summit St., Muir, Michigan, was found guilty of no hunting license/firearm and sentenced to $250 in fines and costs.

Dismissals

– Jerid W. Strzynski, 43, no address listed, one count of disorderly conduct dismissed Dec. 1. “Case is set for trial Dec. 14, 2015. Arresting officer is in marine corps basic training. Due to witness unavailability, the case cannot be proven beyond a reasonable doubt,” according to court records.

– Benjamin Cameron Wolff, 29, of 302 N. Rowe St., Ludington, one count of third-degree retail fraud was dismissed Dec. 2. “Defendant pleaded guilty to a lesser charge,” according to his court file.
