79th District Court sentencings

LUDINGTON — The following were sentenced recently in 79th District Court:

Colby Lee Hamilton, 31, of 2300 N. 28th St., Sheridan Township, was found guilty Sept. 8 of assault and battery. He was sentenced to 63 days in jail with credit for 63 days served; 90 days discretionary jail for two years; and no contact with the victim. He was also found guilty Sept. of fourth-degree child abuse. He was sentenced to 137 days in jail with credit for 137 days served; one year discretionary jail for two years; and contact with the victims. Sentences are concurrent. One count of third-degree child abuse and one count of fourth-offense habitual offender were dismissed.

Donald Thomas Miller, 27, of 11526 Cadillac Ave., Warren, Mich., was found guilty Sept. 9 of reckless driving. He was sentenced to 93 days in jail with credit for 23 days served. Conviction reportable to the Secretary of State (SOS). One count of second-offense driving while license suspended (DWLS) and one count of failure to report an accident were dismissed.

Daniel John Cook, 35, of 203 W. 4th St., Scottville, was found guilty Sept. 9 of attempted fourth-degree criminal sexual conduct (CSC). He was sentenced to 330 days in jail with credit for 271 days served; one year discretionary jail for two years; must register as a sex offender; no contact with the victim or the victim’s mother; and $1,708 in fines and costs. Two counts of first-degree CSC and two counts of second-degree CSC were dismissed.

Christian Jonathan Steiger, 22, of 15260 Forest Park Dr., Grand Haven, was found guilty Sept. 8 of failure to stop or identify after an accident. He was sentenced to 11 days in jail with credit for two days served; 90 days discretionary jail for one year; must attend Victims’ Impact Panel (VIP); and $1,158 in fines, costs and restitution. Conviction reportable to SOS. One count of failure to report an accident and one count of unlawful driving away of a motor vehicle were dismissed.

Israel Flores, Jr., 39, of 102 E. Whittier St., Ludington, was found guilty Sept. 8 of two counts of marijuana distribution without remuneration. He was sentenced to one day in jail with credit for one day served for each count; placed on house arrest for 90 days but may go to scheduled doctor’s appointments; and $1,128 in fines, costs and restitution. His driver’s license is suspended for 180 days and restricted after 30 days. Two counts of delivery/manufacture of marijuana were dismissed.

John Albert Dieterich, 67, of 2807 W. Conrad Rd., Amber Township, was found guilty Sept. 10 of open intoxicants – passenger in a motor vehicle. He was sentenced to $265 in fines and costs. Conviction reportable to SOS.

Kevin Lee Shoemate, 48, of 4211 E. Conrad Rd., Custer Township, was found guilty Sept. 10 of failure to display a valid license and sentenced to $275 in fines and costs. Conviction reportable to SOS.

Dismissals

Dustin James Horn, 20, of 407 E. Melendy St., Ludington, one count of controlled substance possession – schedule 5, LSD, etc. was dismissed Aug. 27. “Defendant is in custody of the Michigan Department of Corrections,” his court file states. “The ends of justice do not require further prosecution at this time.”

Whitney Leigh Petersen, no date of birth or address listed, one count of DWLS was dismissed Sept. 8. “The ends of justice do not require prosecution,” court records state.
