79th District Court sentences as of Dec. 11, 2013

LUDINGTON – The following defendants were sentenced this past week in 79th District Court:
– David Niles Wilcoxson, 2920 N. Luce, White Cloud, was found guilty Dec. 6 of disorderly person. He was sentenced to 10 days in jail with credit for two days served; $285 in fines and costs; 90 days discretionary jail for one year; and no alcohol/drugs.
– Emmet Daniel Meteer, 17, of 410 S. Washington Ave., Ludington, was found guilty Dec. 5 of use/possession of tobacco by a minor and sentenced to 19 hours of community service in lieu of fines and costs.
– Shalyn Dawn Raney, 25, of 1690 Smith St., Muskegon, was found guilty Dec. 3 of third-degree retail fraud. She was sentenced to 18 days in jail with credit for 18 days served; 93 days discretionary jail for two years; and $587 in fines, costs and restitution.
– Kerri Jean Mackey, 43, of 2163 Windsor Lane, Manistee, was found guilty Dec. 3 of stalking and arson of personal property less than $200. She was sentenced to 45 days in jail with credit for 30 days served; two terms of one year discretionary jail for five years; Global Positioning System (GPS) tether for one year; no contact with victim; must have mental health evaluation and follow recommendations; and no alcohol/drugs.
– Westley Myrl Clough, 25, of 203 N. Harrison St., Ludington, was found guilty Dec. 3 of operating while intoxicated or under a controlled substance and pleaded no contest to refusal to obey a police officer’s signal. He was sentenced to two days in jail with credit for two days served for each count; $1,875 in fines and costs; 93 days discretionary jail for the first count; 90 days discretionary jail for the second count; must attend next session of Victims’ Impact Panel; must have a substance abuse evaluation and follow recommendations; no alcohol/drugs; and subject to random preliminary breath tests (PBTs). Conviction reportable to the Secretary of State (SOS). One count of fleeing a police officer, third degree, and operating with a blood alcohol content of .17 or more were dismissed.
– Paul Jason Gerbers, 39, of 1266 E. Hawley Rd., Custer, was found guilty Dec. 3 of larceny less than $200. He was sentenced to two days in jail with credit for two days served; $730 in fines, costs and restitution; and must attend the Economic Crime Program. One count of domestic violence was dismissed.
– Jonathon James Gray, 29, of 406 N. Washington Ave., Ludington, was found guilty Dec. 6 of improper registration, failure to transfer and sentenced to a $90 fine.
– David Alan Courteau, 38, of 4131 E. Dewey Rd., Custer, was found guilty Dec. 3 of larceny by conversion less than $200. He was sentenced to one day in jail with credit for one day served; $580 in fines and costs; and 93 days discretionary jail for one year.
– Crystal Heather Southern, 22, of 602 E. Danaher St., Apt. 3, Ludington, was found guilty Dec. 3 of larceny under $200, send offense. She was sentenced to two days in jail with credit for two days served; $580 in fines and costs; one year discretionary jail for two years; and must attend the Economic Crime Program. She was also found guilty of third-degree retail fraud and sentenced to two days in jail with credit for two days served; $580 in fines and costs; 93 days discretionary jail for two years; must attend the Economic Crime Program; and may perform 29 hours of community service to pay half of fines and costs.
– Robert James Adair, 29, of 206 ½ Third St., Scottville, was found guilty Dec. 5 of disturbing the peace. H was sentenced to one day in jail with credit for one day served; 30 days discretionary jail for one year; $225 in fines and costs; and no alcohol/drugs.
– Jeramy John Schneider, 35, of 501 N. Robert St., Ludington, was found guilty Dec. 5 of disorderly person. He was sentenced to one day in jail with credit for one day served; and $285 in fines and costs.
– Melanie Marie McConnell, 34, of 1088 Pineway, Ludington, was found guilty Dec. 3 of controlled substance use (non-narcotic). She was sentenced to $580 in fines and costs; one year discretionary jail for two years; must have substance abuse evaluation and follow recommendations; no alcohol/drugs; and subject to random PBTs. Driver’s license suspended 180 days/restricted 150 days.
– Jessica Ann Tenney, 30, of 2610 E. Powers Rd., Custer, was found guilty Dec. 5 of driving while license suspended (DWLS) and sentenced to a $90 fine. Conviction reportable to SOS.
– Steven Anthony Davis, 46, of 91 N. Alpine Dr., Walhalla, was found guilty Dec. 3 of impaired driving. He was sentenced to one day in jail with credit for one day served; Alcohol Highway Safety Education (AHSE); $1,145 in fines and costs; 93 days discretionary jail for one year; must attend next session of the Victims’ Impact Panel; may perform 92 hours of community service instead of paying fines and costs; no alcohol/drugs; and subject to random PBTs. Conviction reportable to SOS.
– Richard Anthony Gancarz, 64, of 8619 N. Budzynski Rd., Free Soil, was found guilty Dec. 3 of controlled substance, possession of marijuana. He was sentenced to two days in jail with credit for two days served; 30 days discretionary jail for one year; and driver’s license suspended 180days/restricted 150 days. One count of controlled substance, delivery/manufacture of marijuana was dismissed.
– Collin Derek Trim, 17, of 1873 E. Wilson Rd., Custer, was found guilty Dec. 4 of controlled substance, possession of marijuana. He was sentenced to seven days in jail with credit for seven days served; $580 in fines and costs; must obtain substance abuse counseling; one year discretionary jail for two years; must attend school with no unexcused absences or tardies; subject to a 7 p.m. and 6:30 curfew; and may perform 58 hours of community service in lieu of fines and costs.
Dismissal
– Douglas Harry Bryant, 45, of 2683 Me Tay Wis Rd., Manistee, one count of operating while intoxicated was dismissed Dec. 9 “per plea agreement,” his court records state.

– Mark Steven Brigham, 56, of 6213 N. victory Corners Rd., Ludington, was arrested Dec. 10 by the State, Sheriffs’ Chiefs’ Enforcement of Narcotics Team (SSCENT) for a felony of controlled substance, delivery/manufacture. A preliminary exam is set for Dec. 18 at 11:15 a.m. Bail: $3,500/personal.
– Sheila Ranae Henson, 32, of 504 E. Danaher St., Apt. 1, Ludington, was arrested Dec. 4 by the Mason County Sheriff’s Office (MCSO) for a felony of larceny in a building. A preliminary exam was set for Dec. 11. Bail: $5,000/cash/surety.

– David K. Ward, 59, of 604 Lowell St., Ludington, was arrested Dec. 10 by MCSO for a misdemeanor of domestic violence. A pretrial is set for Jan. 13 at 10:15 a.m. Bail: $3,500/personal.
– Jake Ryan Ring, 22, of 118 Wildwood Crossing, Apt. 7, Ludington, was arrested Dec. 4 by MCSO for a misdemeanor of controlled substance, possession of marijuana. A pretrial is set for Jan. 6 at 11 a.m. Bail: $2,500/10 percent.
– Dwight Robert Hall, 28, of 7161 N. Tuttle Rd., Free Soil, was arrested Dec. 3 by MCSO for a misdemeanor of controlled substance, possession of marijuana. A pretrial is set for Jan. 6 at 11:15 a.m. Bail: $2,500/10 percent.
– Kyle Scott Janicki, no date of birth or address listed, was arrested Dec. 5 by the Scottville Police Department for a misdemeanor of DWLS. A pretrial is set for Jan. 6 at 9:30 a.m. Bail: $150/personal recognizance.
– Alexander I. McCallum, no date of birth or address listed, was arrested Dec. 5 by the Michigan State Police for a misdemeanor of DWLS. A pretrial is set for Jan. 6 at 10 a.m. Bail: $150/personal recognizance.
– Kayla Angel Padilla, 18, of 405 Delia St., Ludington, was arrested Dec. 5 by the Ludington Police Department (LPD) for a misdemeanor of possession of a weapon. A pretrial is set for Jan. 13 at 1:30 p.m. Bail: $2,500/personal.
– Kayla Marie Parrish, 21, of 605 Danaher St., Ludington, was arrested Nov. 4 by LPD for a misdemeanor of second-degree retail fraud. A pretrial is set for Jan. 6 at 1:30 p.m.
– Tonya Ann Johnson, 504 Fifth St., Ludington, was arrested Dec. 5 for a misdemeanor of receiving and concealing stolen property. A pretrial is set for Jan. 6 at 11:45 a.m. Bail: $3,500/personal.
– Joseph John Gustafson, 40, of 5053 W. Kistler Rd., Ludington, was arrested Dec. 7 by LPD for a misdemeanor of operating while intoxicated. A pretrial is set for Jan. 13 at 9:15 a.m. Bail: $2,500/10 percent.
– Brent James Borcherdt, 35, of 4600 Udell Hills Rd., Manistee, was arrested Dec. 7 by Michigan State Police, Hart post for a misdemeanor of operating while intoxicated. A pretrial is set for Jan. 13 at 10:30 a.m.
– Taylyn Louise Leonard, 28, of 6597 Sassafrass Rd., Ludington, was arrested Dec. 8 by LPD for a misdemeanor of operating while intoxicated. A pretrial is set for Jan. 13 at 1:45 p.m. Bail $5,000/10 percent.
