LUDINGTON — The following defendants were sentenced this week in 79th District Court:

– Donnie Dean Francis, 38, of 8578 E. US-10, Branch, was found guilty July 29 of failure to display a valid license. He was sentenced to two days in jail with credit for two days served; $275 in fines and costs; and 30 days discretionary jail for one year. Conviction reportable to the Secretary of State (SOS).

– Brian Kelly Smith, 23, of 7171 E. Stolberg Rd., Fountain, was found guilty July 15 of driving while license suspended (DWLS). He was sentenced to seven days in jail with credit for seven days served; $285 in fines and costs/may perform community service for the balance of fines and costs; and 93 days discretionary jail for one year. Conviction reportable to SOS.

– Chadwick Brian Tolin, 22, of 8386 Mill St., Onekama, was found guilty July 16 of DWLS. He was sentenced to $285 in fines and costs; and 93 days discretionary jail for one year. He was also found guilty for driver transporting open intoxicants. He was sentenced to 90 days discretionary jail for one year; $265 in fines and costs; and no alcohol/drugs. Convictions reportable to SOS. One count of failure to report an accident was dismissed.

– Anthony Paul Miller, 25, of 3150 W. McKinley Rd., Rothbury, was found guilty July 25 of trespassing with an ORV on private property. He was sentenced to $275 in fines and costs.

– Christopher Husted, 37, of 677 Michillinda Rd., Muskegon, was found guilty July 25 of trespassing with an ORV on private property. He was sentenced to $275 in fines and costs.

– James Warren Howe III, 38, of 2544 E. Johnson Rd., Custer, was found guilty July 24 of malicious destruction of a building. He was sentenced to two days in jail with credit for two days served; one year discretionary jail for one year; and $1,131.39 in fines, costs and restitution.

– Todd Allen Gilbert, 43, of 3947 S. Stiles Rd., Ludington, was found guilty July 25 of open intoxicants in a vehicle/passenger. He was sentenced to $265 in fines and costs. Conviction reportable to SOS.

– Samuel Edward West, 23, of 6470 Virnetta Dr., Ludington, was found guilty July 23 of second-degree retail fraud. He was sentenced to $868.56 in fines, costs and restitution; one year discretionary jail for two years; and must attend Economic Crime Program.

– Malynda Lee Patten, 45, of 13133 Dickinson Ave., Bitely, was found guilty July 23 of operating while impaired by liquor. She was sentenced to 30 days in jail with credit for 30 days served; $1,145 in fines and costs; 93 days discretionary jail for one year; must attend next session of the Victim Impact Panel; and must have a substance abuse evaluation and follow recommendations. She was also found guilty of DWLS. She was sentenced to 30 days in jail with credit for 30 days served; $285 in fines and costs; and 93 days discretionary jail for one year. Convictions reportable to SOS.

– Gary Lee Thompson, 36, of 510 E. Melendy St., Ludington, was found guilty July 23 of operating while impaired by liquor. He was sentenced to two days in jail with credit for two days served; $1,145 in fines and costs; outpatient counseling (OP); and 93 days discretionary jail for one year. Conviction reportable to SOS.

– Jennifer Lee Albrecht, 22, of 6604 W. Virnetta Dr., Ludington, was found guilty July 23 of operating while intoxicated or under a controlled substance. She was sentenced to two days in jail with credit for two days served; $1,145 in fines and costs; OP; 93 days discretionary jail for two years; must attend next session of the Victim Impact Panel; must not have/buy/use alcohol or illicit drugs unless she has to (sell alcohol) for employment purposes; and subject to random preliminary breath tests (PBTs). Conviction reportable to SOS. One count of operating with a blood alcohol content of .17 or more was dismissed.

– Travis John Gajewski, 21, of 35 W. Free Soil Rd., Free Soil, was found guilty July 18 of no motorcycle endorsement. He was sentenced to $275 in fines and costs. Conviction reportable to SOS.

– Shon Michael Gascoigne, 22, of 51817 W. Conrad Rd., Ludington, pleaded no contest and was found guilty of breaking and entering with owner’s permission. He was sentenced to two days in jail with credit for two days served; OP; $580 in fines and costs; 90 days discretionary jail for two years; no alcohol/drugs; must attend Alcoholic Anonymous (AA) twice per week for two years; and random PBTs.

– Jonathon Aubrey Johnson, 41, of 404 ½ S. Washington Ave., Ludington, was found guilty of disorderly person. He was sentenced to two days in jail with credit for two days served; $285 in fines and costs; 30 days discretionary jail for one year; and seven months probation.

– Mara Lynn Wittlieff, 18, of 784 N. Stiles Rd., Ludington, was found guilty July 23 of minor in possession of alcohol (MIP), third offense. She was sentenced to $580 in fines and costs; 60 days discretionary jail for one year; and must have a substance evaluation and follow recommendations. Conviction reportable to SOS.

– Timothy Allen Olmstead, 47, of 274 N. Hidden Forrest Ct., Ludington, was found guilty July 23 of controlled substance, possession of marijuana. He was sentenced to $580 in fines and costs; one year discretionary jail for one year; and driver’s license suspended 180 days/restricted 150 days. Conviction reportable to SOS.

Dismissals

– Maurice Edward Nash, 21, of 9095 Homestead Rd., Benzonia, one count of transporting open intoxicants/driver was dismissed July 29.

– Melissa Irene Pettis, 38, of 8949 104th Ave., Pentwater, one count of operating a motor vehicle without security was dismissed July 24.

– David Moreno-Barrios, 25, of 7070 N. 120th Ave., Hart, one count of operating a motor vehicle without security was dismissed.
