The following were recently sentenced in 79th District Court by Judge Peter Wadel:

Patrick Allen Shira, homeless, 23, pleaded guilty on September 12 to trespassing and was sentenced to one day in jail with credit for one day already served, 30 days discretionary jail for one year, 12 months of probation, and $265 in fines and costs.  As part of a plea agreement, the prosecutor dismissed a charge of breaking and entering.

David Wayne Dwyer, 32, 7079 E. Sandra Kay Ave., Branch Township, pleaded no contest on September 20 to domestic violence and was sentenced to one day in jail with credit for one day already served, 93 days discretionary jail for one year, must have a domestic violence evaluation, no contact with the victim, visiting with children must be arranged through third party, and $535 in fines and costs.  

Daniel John Horowski, 33, 3028 Piney Ridge Rd., Hamlin Township, pleaded guilty on September 20 to possession of marijuana (count 1) and using a controlled substance marijuana (count 2).  He was sentenced to two days in jail with credit for two days already served on both counts.  On count 1, he was sentenced to one year discretionary jail for one year, 30 hours of community service in lieu of fines/costs, must have substance abuse counseling, no drugs/alcohol, subject to random PBTs, subject to random drug tests, $295 in fines and costs, and license suspended for 365 days and restricted for 305 days.  Conviction is reportable to Secretary of State.  On count 2, he was sentenced to 90 days discretionary jail for one year, 67 hours of community service in lieu of fines/costs, and $665 in fines and costs.  The prosecutor dismissed additional charges of possession of marijuana, three counts of driving while license not valid, and refusing to take a preliminary breath test.

Douglas Loyde Currier, 63, 3155 S. Scottville Rd., Eden Township, pleaded guilty on September 22 to driving while license suspended/revoked/denied and was sentenced to two days in jail with credit for two days already served, 30 days discretionary jail for one year, 12 months of probation, and $285 in fines and costs.  Conviction is reportable to Secretary of State.

Kinney Rd., Riverton Township, pleaded guilty on September 22 to driving while license suspended/revoked/denied and was sentenced to two days in jail with credit for two days already served, 30 days discretionary jail for one year, 12 months of probation, and $285 in fines and costs.  Conviction is reportable to Secretary of State.

Tyler Stephen Rodriguez, 25, 723 Fulton St. E, Grand Rapids, pleaded guilty on September 22 to failure to display a valid driver’s license and was sentenced to pay $275 in fines and costs.  Conviction is reportable to Secretary of State.

Dismissals

Darius Malik Fluellen, 20, 19437 Burt Rd., Detroit, had a charge of possession of marijuana dismissed on September 20 as part of a circuit court plea agreement.

Dale Gerald-Edward Hauri, 48, 3859 W. Prairie Rd., Shephard, Michigan, had charges of possession of marijuana, possession of a controlled substance less than 25 grams, and operating while license suspended dismissed without prejudice on September 22.  Court records state, “Further prosecution at this time would not serve the ends of justice.”

Bryan Wendell Griffin, 58, 292 S. Meyers Rd., Amber Township, had a charge of operating without security (no motor vehicle insurance) dismissed without prejudice on September 22.  Court records state, “Defendant pleaded guilty to a lesser charge.”

Matthew David North, 33, 128 N. Taylor Rd., Branch Township, had a charge of operating without security (no motor vehicle insurance) dismissed without prejudice on September 22.  Court records state, “Defendant pleaded guilty to a lesser charge.”

Noah Michael Turner, 20, 508 Griswold St., Hart, had two counts of third degree retail fraud (shoplifting) dismissed without prejudice on September 22.  Court records state, “People cannot prove beyond a reasonable doubt.”

David Gene Newman, 43, 459 32nd St. SW, Wyoming, Michigan, had charges of illegal license plates and operating while license suspended dismissed without prejudice on September 22.  Court records state, “Defendant pleaded guilty to a lesser charge.”

Zachary Scott Martinsen, 23, 2884 E. Mavis Rd., Sherman Township, had charges of operating without security (no motor vehicle insurance) and illegal license plates dismissed without prejudice on September 22.  Court records state, “Defendant pleaded guilty to a lesser charge.”
